US sanctions against Iran: the ICJ considers itself competent to judge the dispute

The International Court of Justice (ICJ), a UN institution responsible for settling disputes between states, considers itself competent to judge a complaint filed by Tehran in 2018 against the sanctions imposed by the Trump administration.

Washington was opposed to the case, but will not convince the judges.

When it comes to Iran and the United States, there is something incongruous about talking about friendship.

And yet ... It is on the basis of an old friendship treaty dating from 1955 that Iran decided to file a complaint against the United States in 2018. The decision followed the American withdrawal from the agreement. on Iranian nuclear power, decided by the Trump administration, which then imposed new sanctions on Iran.

Tehran had therefore unearthed this old treaty of friendship allowing it to

bring the issue of sanctions

to the International Court of Justice.

Washington immediately denounced a "obsolete" treaty which it officially ended in 2018 after the ICJ ordered it to ease sanctions on humanitarian products and challenged the competence of judges.

Wasted effort. 

Despite the attempts of the United States, the judges consider themselves competent.

The rest of the case, the substance of the case, will not be decided for years.

Unless it never is if Tehran were ultimately to decide to withdraw this complaint, if we were moving towards some form of normalization between the two countries. 

Reacting to the ruling by the International Court of Justice, Iranian Foreign Minister Mohammad Javad Zarif said it was a “

 victory 

” for Iran.

The Biden administration says it wants the United States to return to

the 2015 nuclear agreement to

which France, the United Kingdom, China, Russia, Germany and therefore Iran are parties.

A return conditional in particular on the access of international observers to Iranian nuclear installations.
