Potsdam (dpa / bb) - The left-wing faction in the Brandenburg state parliament has asked State Justice Minister Susanne Hoffmann to intervene in the conflict between the Frankfurt (Oder) public prosecutor's office and the Bernau youth judge Andreas Müller.

The public prosecutor's office had requested that Müller be declared biased in proceedings against an adolescent for possession of cannabis, because the judge had been campaigning for the legalization of cannabis for years.

After the application was rejected by the Bernau District Court, the public prosecutor filed a complaint against it.

The state government must counter the impression that attempts are being made in Brandenburg to influence the jurisdiction of judges for certain proceedings, said the right-wing political spokeswoman for the left-wing faction, Marlen Block, on Wednesday.

"I expect a clear statement from Minister Hoffmann in favor of an independent judiciary and against further action by the Frankfurt (Oder) public prosecutor's office in this case."

In April 2020, Müller had filed a judicial review suit with the Federal Constitutional Court because he considered the cannabis ban to be unconstitutional.

Then Müller had suspended the process against the adolescent until the decision of the Federal Constitutional Court.

Thereupon the public prosecutor's office filed the bias application against Müller, which was rejected by the Bernau District Court in January.

The district court has to decide on the complaint of the public prosecutor's office.
