However, he has already made it clear that there are fundamental doubts about the legality of the night curfew and the 15-kilometer radius of movement.

The general decree of the district administrator of January 22, 2021 will "with a predominant probability turn out to be unlawful," says the message.

It was not disclosed whether and when there would be a fundamental decision.

The court ruled that the orders, which are unlimited in time and cover a large area of ​​validity, affect such a large group of people that the measures should have been implemented not by general decree but by ordinance.

The massive restriction on movement was also to be regarded as illegal in the matter.

It is understood by the complainants as a travel ban.

However, an exit ban can only come into consideration, "if there is a very high probability that people in the district are infected with the coronavirus undetected and therefore their departure from the district should be prevented to protect people outside the district", says it in the message.

The general decree did not provide any justification for such far-reaching restrictions.

It is also not immediately apparent where the 15-kilometer radius ends.

Since crossing this limit can be punished with a fine of up to 25,000 euros, it must be ensured that such an offense can be recognized without the use of aids.

Since Monday it has been forbidden in the Vorpommern-Greifswald district between 9 p.m. and 6 a.m. to leave your own apartment or property without good reason.

In addition, you must not move further than a 15-kilometer radius from your place of residence for no reason.

These increased protective measures against the spread of the coronavirus have come into force because the district has had a higher incidence value than 150 new infections per 100,000 inhabitants in one week and is therefore a high-risk area.

The decisions of the administrative court only apply to the parties involved in the proceedings.

They could lodge a complaint against the decision within a period of two weeks, on which the Higher Administrative Court in Greifswald would have to rule.
