A 25-year-old Tunisian was sentenced Wednesday by the Bordeaux Criminal Court to two months in prison with a committal warrant, and a ban from French territory for five years.

He was found guilty of evading the execution of an obligation to leave the territory, by refusing to undergo a PCR test for Covid-19, reports

In an irregular situation, the young man was notified last December of an obligation to leave French territory by the prefecture of Charente, then was placed in the administrative detention center (CRA) of Bordeaux.

Reasoning "by analogy" denounces the defense

But Tunisia requires a negative PCR test for any entry on its soil.

Twice at the beginning of this week, the Tunisian refuses to take this test.

The president of the court suggests that the individual would have been advised by a lawyer, he retorts that he is afraid of pain.

"He is an obstacle to his escort to the border" considers in any case the prosecutor.

Reasoning "by analogy" denounces the defense, which considers that refusing a test "does not constitute an obstruction".

The lawyer decided to appeal.
