• Grace measures: The Government freezes pardons in Catalonia for the 14-F

  • 1-O The Prosecutor's Office reports against the pardons of 1-O: "It is not a measure to satisfy temporary political interests"

The Supreme Court has requested this Tuesday a report to the

State Bar

on the pardons of those convicted in the case of the

procés

, according to legal sources.

The

Criminal Chamber

, in an ordering procedure of the attorney of the Administration of Justice of special causes, will hear the criteria of the legal services of the Government before issuing its report - mandatory but not binding - on the granting of the measures of Thanks to the leaders of 1-O.

On the other hand, in a ruling, the court presided over by Magistrate Manuel Marchena has refused to include the report presented by the popular action in this case, the political party Vox, in the file of said pardons, as it does not provide for article 24 of the

Pardon Law.

the opinion of the popular action, since it limits the request for reports to the Public Prosecutor's Office and to the party harmed by the crime, in this case, to the State Attorney as the "offended" party of the crime of embezzlement of public funds.

For its part, the Office of the High Court Prosecutor already reported last December against the granting of pardons to Oriol Junqueras and the rest of those convicted of the separatist defiance upon understanding that the

Constitution

prohibits general pardons and that the promoters of the

procés

have not shown any regrets for transgressing current legislation.

The Public Ministry also stressed the seriousness of the crimes for which they were convicted.

Legal sources consulted by

maintain that it is highly probable that the Criminal Chamber will also report against the Executive pardoning the leaders of 1-O after obtaining the opinion of the State lawyer.

However, these reports are not binding for the decision that the Government of Pedro Sánchez may adopt.

However, if the coalition government agrees to pardon the promoters of 1-O, it must give reasons for the decision because, against the royal decrees of pardons approved by the Council of Ministers, it is possible to file appeals before the Contentious Chamber -Administrative of the Supreme Court.

In 2013, the magistrates of the Third Chamber ruled that, although the pardon is a discretionary measure granted by the Council of Ministers, it must be justified and submitted to the control of the courts in order to avoid an "arbitrary" action by the public powers.

The Public Ministry has already warned that the grace measures are not planned "to satisfy temporary political interests."
