Magdeburg (dpa / sa) - The higher administrative court in Magdeburg has rejected an urgent application from a Halle resident against the 15-kilometer radius of movement in the corona pandemic.

The court announced on Tuesday.

The applicant had objected that the norm of the city of Halle violated the Basic Law and restricted those affected in their freedom of movement.

The relevant regulation was issued by Mayor Bernd Wiegand (independent), who was not responsible for it, according to the applicant's argument.

In addition, the city lacks local authority for the relevant standard.

This is not authorized to restrict the freedom of movement of its residents outside of their urban area.

"After the only possible and necessary summary examination in the preliminary legal protection proceedings (...) the regulation does not turn out to be obviously illegal," the court announced on Tuesday.

In accordance with the containment ordinance of Saxony-Anhalt, the districts and independent cities were authorized to take local measures, including restricting the radius of movement to 15 kilometers around the place of residence.

The basic requirement is that the incidence value of 200 new infections per 100,000 inhabitants in the past seven days is exceeded for a longer period of time.
