Munich / Aschaffenburg (dpa / lby) - The Bavarian Administrative Court (VGH) has rejected the action brought by a lawyer from the Aschaffenburg district against the 15-kilometer rule that applies in the Free State.

The applicant did not come from a so-called hotspot and was therefore not affected by the regulation, as a spokesman for the VGH announced on Friday.

"Main-Echo" reported earlier.

Since the incidence value in the Aschaffenburg district is below 200, the 15-kilometer rule would have no effect on the applicant, argued the court.

An appeal against the decision of the VGH is not possible.

The lawyer from Aschaffenburg submitted the application for a client last week because he did not consider the provision to be sufficiently specific.

It is not clear what is to be classified as tourist, nor when a day trip can be assumed.

Another application for the 15-kilometer rule was rejected for the same reason.

The court did not want to decide when a decision on the four other applications on the legality of the 15-kilometer rule would be made.

Since January 11, excursions have only been possible within a radius of no more than 15 kilometers around the place of residence if the Robert Koch Institute (RKI) in the independent city or district concerned has more than 200 new infections per 100,000 inhabitants within one week reports.

As of Friday, the rule applies in 30 Bavarian districts and cities.
