  [Commentary] In 2018, the Commission for Discipline Inspection of Yuhuan City, Zhejiang Province investigated and dealt with a typical case that seriously violated the rights and interests of migrant workers.

The origin of the case was that in August 2016, a migrant worker came to the local Commission for Discipline Inspection and made a real-name report to Wu Fukang, the former director of the Urban Labor Security Office of Yuhuan County.

The migrant worker said that because of a work-related injury, he used the labor and social security office to conduct arbitration and mediation with the company. During the entire mediation process, Wu Fukang did not arrange for him to meet with the company. The work-related injury compensation was also transferred by Wu Fukang. The mediation agreement says 4 5,000 yuan, but only 37,000 yuan was actually given to him. The difference was 8,000 yuan. Wu Fukang explained that it was written more on paper for corporate tax deductions, but he believed that it was intercepted by Wu Fukang for corruption.

The Commission for Discipline Inspection quickly launched an inspection of this clue.

  Sun Wanqin (Staff of the Commission for Discipline Inspection of Yuhuan City, Zhejiang Province): I went to the company to understand that the company and Wu Fukang were actually talking about the same thing, and he said it was for tax deduction.

  [Commentary] The reason for this situation is actually because the migrant worker went to the Labor Security Institute before making the report and shocked Wu Fukang. He privately returned 8,000 yuan to the company and agreed with the company. Both sides agreed Only lost 37,000.

Wu Fukang knew that the consequences of what he had done would be severe once it was exposed, so he tried every means to conceal the truth and fight the investigation.

I did not tell the workers how much the company lost. I did hide it.

  [Commentary] Although obstacles were encountered as soon as the investigation came up, the investigation team noticed that Wu Fukang violated many work regulations and procedures during mediation and felt that things should not be that simple.

  Sun Wanqin: If the compensation book is inconsistent with the actual payment, these are not in compliance with the regulations.

The parties to the migrant workers and the business owners do not mediate on the spot. During the mediation process, Wu Fukang is all alone, which does not meet the requirement that two or more people participate in mediation.

  [Commentary] Whether Wu Fukang committed corruption and accepting bribes, the investigation team felt that it could not stop there.

Yuhuan is one of the top industrial counties in the country’s county economy. There are more than 10,000 industrial enterprises on a land area of ​​less than 400 square kilometers. The protection of the rights and interests of migrant workers, especially migrant workers, is a key issue that the city must solve. Clues to issues involving infringement of their rights cannot be easily let go.

The investigation team collected hundreds of industrial injury and occupational disease arbitration and mediation files handled by Wu Fukang in recent years, contacted the enterprises and workers involved one by one, and checked the amount of compensation.

We are also determined that there must be a problem.

  [Commentary] Most of these migrant workers come from all over the country and are highly mobile. Some have gone to work in other cities, and some have already returned to their hometowns. For this reason, the investigation team went to six or seven provinces including Anhui, Hubei and Jiangxi. It took more than a year to search for relevant migrant workers, and found multiple parties involved, and obtained solid evidence of corruption and interception by Wu Fukang.

  Liang Guodong: I remember that when we went to Jiangxi to collect evidence, there was a person named Zheng Tonglou. When the evidence was collected, he had second-degree pneumoconiosis and was dying. He passed away not long after we collected the evidence.

In the work-related injury arbitration of 150,000, only more than 90,000 were obtained.

  [Commentary] In 2018, 54-year-old Zheng Tonglou died of pneumoconiosis.

He and his wife Sun Qiaozhi left their rural home in Jiangxi to work in Yuhuan in 2001, hoping to earn more money and give their daughter a better living environment and education conditions.

Zheng Tonglou works in an auto parts factory. The process where he works is very dusty, and the company did not have any protective measures in the early years.

By 2014, Zheng Tonglou's condition was getting worse and worse. He was identified as stage III pneumoconiosis and constituted a second-degree disability.

  Sun Qiaozhi (Zheng Tonglou's wife): Wearing a ventilator for eating and sleeping.

When it comes to compensation, the factory still refuses to compensate.

Although we have been there for more than ten years, the company later ignored it and refused to let us in.

  [Commentary] Healing the illness quickly ran out of all savings and owed a debt. At that time, my daughter was in the third year of junior high school and dropped out of school because of the difficulties at home.

  Sun Qiaozhi: We can’t do anything without paying. It’s not a problem for my husband to wear a ventilator over there and wait. Later, we hired a lawyer to do it there, and the lawyer gave us some money back.

  [Commentary] The lawyer told them that Wu Fukang, the director of the Labor and Social Security Institute, would help them find corporate arbitration.

After a while, the lawyer notified them to collect compensation. The mediation statement and invoice were written 150,000, but the cash given was only 100,000. The lawyer also said that the difference was tax deductible, and the couple gave the lawyer 10 as agreed. % Agency fee, only 90,000 won.

The investigation team contacted the relevant company for inquiries. The company stated that the compensation paid to Wu Fukang was indeed 150,000, and the fact of embezzlement was confirmed.

  Sun Qiaozhi: Actually, it’s 50,000 yuan. We know this in our own minds. I didn’t sue him or anything. My husband is also an honest person. Others are sick like that. He keeps saying that it’s not him who helped us. , We can't come, he meant it.

  [Commentary] Many migrant workers found by the investigation team experienced similar bitterness.

Almost all of them are low-income and poor social groups. In order to earn money and support their families, they work hard and work in a high-risk environment for a long time. When they suffer work-related injuries and related companies shirk their responsibilities, they face unemployment, treatment, etc. Survival pressure urgently needs financial compensation.

At this time, the labor and social security department became the hope of the disabled workers and their families. Facing the ardent expectations of the disadvantaged groups, it should have helped the workers, but Wu Fukang made the situation worse, taking the difference from the workers’ life-saving money.

Moreover, Wu Fukang does not dare to intercept every case, but specifically selects migrant workers who live in other places, who look simple and do not question him.

Such behavior seriously gnaws at the masses’ sense of gain and erodes the political foundation of the party’s governance.

After listening to the migrant workers about the difficulties they had encountered, the investigation team was determined to give them justice.

  Liang Guodong: The grievances of each worker are deeply moved to me.

After they are injured, their means of earning a living may also be greatly affected. The amount of compensation is very important to them. They must be traced to the end, and the stolen money must be tracked down and returned to the injured at work.

  [Commentary] The investigation team also noticed that many migrant workers mentioned that there is another role between them and Wu Fukang, which is acting as a lawyer.

In the case mediated by Wu Fukang, the names of two lawyers frequently appeared, one named Lei Jice and the other named Huang Dourong.

The investigation showed that the two people actually had neither a lawyer’s license nor a basic-level legal service worker’s license. It was found that helping workers defend their rights is a way to make money. They often stood at the entrance of the hospital under the banner of a lawyer to solicit business. The above is only an intermediary agent, and each order collects an agency fee of 10% to 20% of the compensation.

They colluded with Wu Fukang for mutual profit.

  Liang Guodong: In the process of investigating Wu Fukang's case, we found a clue, that is, the number left by the injured party was actually the number of the wild lawyer.

Ye lawyer can act as Wu Fukang's lobbyist. If (migrant workers) have any doubts or ask the factory, he will use the Ye lawyer to appease and persuade him.

  [Commentary] Since neither of them are real lawyers, the compensation for the workers is mainly dependent on Wu Fukang to mediate with the corporate arbitration.

Therefore, they often give Wu Fukang gifts such as supermarket cards, tobacco, alcohol, and tea to build a good relationship with him.

  Lei Jice (person involved in the case): If you do this without a certificate, you must know the person in charge. He is the director of the labor office. No matter what, he will deal with this case like this.

There must be a price difference, this is very clear, what tax deduction is deductible.

  [Commentary] The investigation of the two proved that the two knew about Wu Fukang’s withholding compensation for a long time, and instead endorsed Wu Fukang’s claim of "tax deduction" in front of the migrant workers.

Wu Fukang also needs such people to communicate and cooperate to dispel the doubts of migrant workers.

When the compensation comes down, the two can get the agency fee, and Wu Fukang can withhold it, and both parties benefit.

  Wu Fukang (formerly director of the Urban Labor Security Office of the Yuhuan County Human Resources and Social Security Bureau): He asked for 100,000, and I negotiated with the company about 150,000.

I was thinking at the time, I was like doing business. How much money they asked for, and if I met their requirements, I would make the difference and make a little meaning.

  [Commentary] Wu Fukang, as a public official, has turned his duties into a business. He has his own business experience in dealing with migrant workers and the factory.

On the side of migrant workers, Wu Fukang tried to keep their expectations down and convinced them to accept mediation with a lower amount.

On the factory side, Wu Fukang talked about the compensation.

Using this model, he withheld a total of more than 290,000 yuan from the work-related compensation of 31 migrant workers.

  Liang Guodong: As a public official, Wu Fukang's behavior is actually rather bad.

When we were in custody, many people heard about this and applauded.

It is also our wish for law enforcement and discipline executors to be able to obtain the recognition of the business side and the injured workers.

  [Commentary] In 2019, the People's Court of Yuhuan City, Zhejiang Province publicly pronounced a verdict on this case, and many migrant workers came to watch.

Wu Fukang was sentenced to three years and four months’ imprisonment for corruption and bribery, and a fine of 400,000 yuan, as well as a recovery of 325,400 yuan.

The recovered compensation was delivered to the parties one by one.

  Sun Qiaozhi: The money came to us last year, 50,000 yuan.

Thanks to the Commission for Discipline Inspection for helping us find it. If the Commission for Discipline Inspection does not help us find it, we will definitely not get the money.

  [Commentary] In March 2019, a person named Sun Xiaoguo was arrested by the People’s Court of Guandu District, Kunming City for an intentional injury case. He and his accomplices fought in a KTV, kicked the opponent’s bladder and beat the opponent to second level Seriously injured.

The investigation by the public security agency found that Sun Xiaoguo had registered many companies and operated many bars and nightclubs. He was a famous "big brother" on the Kunming night market. Behind the seemingly legitimate company coat is actually a gang involving criminals and criminals, doing many illegal and criminal activities. Opening casinos, lending usury, illegal detention, intentional injury, etc.

Once the name Sun Xiaoguo was announced, it caused a sensation.

Many people in Kunming have the impression that there was a Sun Xiaoguo more than 20 years ago who committed many serious crimes and was sentenced to death.

Is this the same Sun Xiaoguo?

  Jiang Biao (the first-level sergeant of the Criminal Investigation Detachment, Kunming Public Security Bureau, Yunnan Province): The death penalty should have been executed. Why didn't he die?

At that time, Sun Xiaoguo was not the principal offender and was under 18, and was sentenced to three years in prison.

However, in 1997, Sun Xiaoguo, who was supposed to be serving his sentence in prison, appeared bizarrely in the society and raped 4 underage women again, one of whom was a girl under the age of 14.

He also illegally detained and tortured and insulted two women, with extremely cruel methods and terrible injuries.

His abusive behavior aroused strong public outrage at the time. After investigation, it was found that Sun Xiaoguo's mother Sun Heyu and stepfather Li Qiaozhong illegally obtained a bail pending trial for Sun Xiaoguo in 1995, and subsequently illegally obtained medical parole for him.

  Chen Hao (Staff of the Commission for Discipline Inspection of Yunnan Province): Sun Xiaoguo’s mother had an unprincipled love for Sun Xiaoguo. She gave him a fake medical record and went on parole for medical treatment. The first time he escaped Punishment.

I didn't go to jail for a day.

  [Commentary] Sun Xiaoguo’s mother, Sun Heyu, formerly Sun Xuemei, was a police officer of the Guandu Branch of the Kunming Public Security Bureau. His stepfather Li Qiaozhong was then the deputy director of the Wuhua Branch.

In 1998, the two were investigated for sheltering Sun Xiaoguo’s 1994 rape case. Sun Heyu was expelled from public office and sentenced to five years in prison for sheltering; Li Qiaozhong was subject to party probation for two years and dismissal; Sun Xiaoguo was granted bail for violation of regulations The two policemen awaiting trial were also held criminally responsible for dereliction of duty.

Sun Xiaoguo was also sentenced to death by the Kunming Intermediate People’s Court in February 1998 for committing multiple serious cases again in 1997.

The public thought that the matter would end here, but they did not expect a similar plot to be staged again 20 years later, and this time it was even more bizarre, "resurrected from the dead."

Thorough investigation and publication of the truth of Sun Xiaoguo's case is about the society's confidence in the fairness and justice of the rule of law.

Why is Sun Xiaoguo's case so impactful? It really touched the bottom line of ordinary people's hearts.

  [Commentary] The investigation found that after Sun Xiaoguo was sentenced to death in the first instance in 1998, he had undergone two revisions.

The first time was in 1999. After Sun Xiaoguo was sentenced to death, he appealed. After the second instance, the Yunnan Provincial Higher People's Court changed his sentence to a two-year reprieve.

After investigation, there were errors in the determination of facts and the application of the law in the revised judgment of the second instance, but no plot of favoritism was found.

After the death sentence was changed, Sun Xiaoguo was sent to the No. 1 Prison of Yunnan Province. According to the law, if there was no new crime during the two-year reprieve, he was transferred to life imprisonment.

If Sun Xiaoguo served his sentence in accordance with the law, it would no longer be a disaster for the society. However, after his mother Sun He was released from prison in 2003, she had another idea to get people out of prison.

  Sun Heyu (Sun Xiaoguo's mother): Very contradictory, and hate him very much. It's impossible if you don't hurt him. I always want him (punished) to be lighter and spoil him. This is my problem.

Do you fail to be a mother?

A failure, really, a failure.

  [Commentary] Sun Heyu had been expelled from public office at that time, but Li Qiaozhong's career has improved again, serving as the director of the Wuhua District Urban Management Bureau.

Sun Heyu and Li Qiaozhong asked him to find a relationship again, and Li Qiaozhong agreed.

  Li Qiaozhong (Sun Xiaoguo's stepfather): He was born to his mother, and his mother is my wife. As his stepfather, his mother must have brought this thing up to find an acquaintance to speak better and to be more accommodating.

  [Commentary] The investigation found that it was the multi-party operation of Li Qiaozhong and Sun Heyu that led to the retrial of the Sun Xiaoguo case initiated by the Yunnan Higher People's Court in September 2007, and Sun Xiaoguo was sentenced to 20 years in prison with a suspended death sentence.

This retrial is obviously extremely abnormal.

  Chen Hao: According to the law, new evidence and new facts are required to initiate a retrial. In fact, this case does not meet this requirement.

  [Commentary] The investigation team followed the process of this retrial, comparing the authority and responsibilities of each gate one by one, and thus locked down the person responsible for each gate, and found that public officials in multiple links were seriously swindling the law.

  Tian Bo (the President of the Case Filing Division of the Yunnan Higher People's Court at the time): I accept everything when dealing with me.

Because the final impact of this case on society is really too bad, really too bad.

I shed tears on the day the sentence was received. I was a judge for a lifetime, and finally became a criminal.

The registration pass is the first pass of the retrial, and it was Tian Bo who made the first opening.

Sun Xiaoguo's stepfather, Li Qiaozhong, once served in the army. He found out that Tian Bo had also served in the same army, so he asked his comrades to ask him for dinner.

  Zhang Xuepin (a staff member of the Yunnan Provincial Commission for Discipline Inspection and Supervision): Two times, 50,000 yuan was given to Tian Bo with 100,000 yuan each time. In this process, Tian Bo tried every means to think of ways for Li Qiaozhong.

  Tian Bo: Regardless of my comrade-in-arms or Li Qiaozhong, don't resent others, resent yourself.

There is a saying in psychology that is very good, you have this hook in your heart that other people can hang things, if you don't have this hook, others can't hang this thing, you are not sure of yourself.

  [Commentary] After the case was filed, it was the trial. Li Qiaozhong and his wife naturally took Liang Zi'an, the head of the trial supervision court, as a key public relations object, and bribed him more than 100,000 yuan.

  Liang Zi'an (then President of the Trial Supervision Division of the Yunnan Higher People’s Court): When changing this case, I actually knew that it was wrong at the time. What was handed over to you was a pass. You can’t hold this pass. This is a lesson.

  [Commentary] At that time, Liang Zian knew that this case should not be changed, but his face could not be wiped away, so he told Li Qiaozhong and his wife that this matter was difficult, and suggested that they find another hospital leader.

Zhao Shijie was the dean of the Yunnan Provincial Higher Court at that time. Although Li Qiaozhong didn't know Zhao Shijie, he went around the corner and found someone who could talk to Zhao Shijie.

  Liu Tianming (at the time, he was a member of the Deputy Prosecutor’s Task Force of the Xishuangbanna Prefectural Prosecutor’s Office): Li Qiaozhong is a person who has a good grasp of the unspoken rules of Chinese society. This matter is left to him. Although he is not a big official, he passed around. One of them was Yuan Peng, the secretary of Qin Guangrong, the governor of Yunnan at the time. Li Qiaozhong got to know Yuan Peng through a private boss. For 30,000 yuan, Yuan Peng accepted the entrustment and called Zhao Shijie.

  Zhang Xuepin: Yuan Peng is the secretary of the main leaders in the province. At that time, Li Qiaozhong told Sun Heyu that he was a secretary, and how powerful the officials behind him are, and how powerful they are, the other party will consider it when they receive a call. It must be this person. You mentioned this matter to me, or the person behind you mentioned it to me.

  [Commentary] These hellos around the circle played a role. Zhao Shijie approached Liang Zi'an, the president of the trial supervision court at the time, to mention the case, to the effect that he would move if he could.

  Liang Zi'an: He is a person, he is not that kind, and he usually pulls it down if he expresses his intention.

I only had to express my reservations at the time. If not, it would do.

But there is no one after all.

I said that I am, the first sentence is blindly following the leadership, and the second sentence is that I have lost principle.

  [Commentary] The investigation found that the retrial of the Sun Xiaoguo case lasted one year and three trial committee discussions were held. The reason for repeated discussions was precisely because many members of the trial committee believed that the factual evidence in this case was correct and that the judgment should not be changed.

In this solemn conference hall of the Jury Committee, as long as everyone enters here, they should reject all external influences and only look up to the supreme law. Unfortunately, a few people eventually bring human relations and leadership will into the space of the law. , And above the law.

  Liang Zi'an: The last time I met, the statement was like this. If the facts did not change, the sentence was changed. No one dared to change the facts in this case.

  [Commentary] In this way, Sun Xiaoguo completed an important step of "resurrection", and the sentence became 20 years in prison.

The investigation found that Li Qiaozhong and his wife were also active in the prison system at the same time, and the operation violated the rules and reduced their sentences. The then political commissars of the Yunnan Provincial Prison Administration Bureau Luo Zhengyun and Li Qiaozhong were both fellow villagers and comrades-in-arms, so they agreed to help him regardless of principle.

  Luo Zhengyun (the political commissar of the Yunnan Provincial Prison Administration at the time): From 1983 to 1997, he worked in the army. He was in the same army with me. He was in a superior relationship with me and was a comrade in arms.
