Frankfurt / Gießen (dpa) - The Higher Regional Court (OLG) Frankfurt has declared the conviction of the Giessen doctor Kristina Hänel for advertising for the termination of the pregnancy to be final and rejected the appeal.

The doctor's homepage not only provides information that abortions are being carried out, but also contains detailed information on “how”, it said.

This means that she cannot rely on the exception regulated in the criminal code, according to a statement published on Tuesday (Az. 1 Ss 96/20).

Hänel announced a constitutional complaint against the non-appealable decision.

"In other countries such as Ireland, Argentina and South Korea, the laws are being liberalized, nowhere else is there a criminal law paragraph that prohibits factual information," said Hänel about paragraph 219a.

In view of the major problems that the corona pandemic brings with it, it seems "increasingly absurd to hold on to this unspeakable relic".

In November 2017, the Giessen doctor was fined by the Giessen District Court for advertising the termination of the pregnancy.

The district court of Giessen rejected her appeal against this judgment almost a year later.

The appeal filed against this led to it being repealed and referred back to the court.

Reference was also made to a changed legal situation.

The district court then changed the judgment under appeal and sentenced the doctor to a fine.

Now the OLG has rejected the appeal against this judgment.
