As every six months, the treatment boards of the prisons in which they serve a sentence for sedition, the independence leaders sentenced by the Supreme Court decide whether to propose their prison classification.

Half a year ago they agreed that they were deserving of a third degree, as later endorsed by the Generalitat, which has the powers, which implied their release from prison for a good part of the day and only sleep four nights.

However, the decision of the Catalan administration was the beginning of a judicial storm that culminated in the revocation of this third degree by the Supreme Court at the beginning of December, after estimating an appeal from the Prosecutor's Office.

The magistrates accused the Catalan prison administration of trying to "reinterpret the sentence" and apply "a privileged prison treatment" to the independence leaders.

Despite this judicial decision this Thursday, the treatment boards of the prisons of Lledoners, Wad-Ras and Puig de les Basses have unanimously agreed that the prisoners should once again have the third degree penitentiary, so now it is the turn of the Generalitat to grant it or leave them in a second degree and, therefore, locked up as now.

The Department of Justice has a period of two months to make the decision, although as happened six months ago it could not rush that time and grant them semi-release in the coming days.

One of the arguments would be that in mid-February the nine convicted of sedition have already served a quarter of their sentence, so they can begin to have prison permits.

Now only five of them have it.

Thus the prisoners would also go out every day to work or do volunteer work.

It is not ruled out that they have an active presence in the Catalan elections, despite the fact that the date of February 14 is currently in the air due to the health crisis caused by the coronavirus.

Six months ago Jordi Sànchez, Jordi Cuixart, Joaquim Forn, Josep Rull, Oriol Junqueras, Raül Romeva and Jordi Turull spent 14 days in third grade.

A Penitentiary Surveillance Court, after estimating a request from the Prosecutor's Office, ordered his entry back into prison until the final decision of the Supreme Court, as sentencing court, despite the fact that it was in favor of that third degree.

The situation contrasted with that of Carme Forcadell and Dolors Bassa who continued with semi-release, with judicial endorsement, until in December the sentencing court revoked this penitentiary classification.

Now the Supreme Court will have the last word again.
