The Court of Instruction number 2 of

Santiago de Compostela

has forced

an old woman from a residence in the Galician capital

to be vaccinated against

coronavirus due

to the daughter's refusal to be vaccinated and given the degree of cognitive impairment of the woman to make a decision , as collected by the car.

The proceedings began on Saturday, the 9th, when this court was on duty and as a result of the request sent by the

Domus Vi San Lázaro residential center for the elderly

regarding the

vaccination

campaign

for its residents, scheduled for the following day, and the refusal of the woman's daughter to receive the vaccine.

In its letter, the center pointed out that the old woman had a "very limited" capacity from the cognitive point of view, something that the car confirms after collecting the forensic report.

This affirms that the woman "is not, due to the degree of cognitive deterioration suffered, in a condition to participate, even minimally, in the decision that is adopted about the convenience of her

vaccination

."

For this reason, and after hearing the daughter's arguments, including possible side effects, the judge emphasizes the "lower risk" of administering the vaccine to the elderly woman, while referring to the forensic report on the safety of vaccines defended by the World Health Organization (WHO).

ARGUMENTS

In the car,

the judge rejects the reasons adduced by the daughter

, whether they are "shared", indicates about "the difficulty and the burden of responsibility that the obligation of having to decide for another person entails" or they are not.

"The pressure to which he is subjected by the position adopted by his brothers and the fear that their reaction instills in the face of potential unwanted effects of the

vaccine,

" he adds about another of the arguments presented by the daughter of the old woman.

On the contrary, he insists that both the communication made by the residence, that the woman

"lacks the precise powers to make a consequent decision"

and that, he adds, "the daughter has confirmed", and the forensic report, evidence that the old woman has no "capacity" to decide herself.

In this context, and given the fact that the vaccine was to be given the next day, it refers to the "benefit" of giving the vaccine versus the "greater risk" of not doing so.

"While it is true that the very fact of

vaccination

is a risk", it is important to note that omitting it "also entails it".

Likewise, it alludes to the forensic report itself and to that established by the WHO, the number of fatalities from the

pandemic

and the fact that the "risk increases as the administration of the vaccine is delayed and the number of infections increases."
