He needs a lot of support in everyday life and can not take a regular job.

It is stated in a certificate from the doctor, it assesses the municipality's LSS administrator and it is also the assessment that the Swedish Public Employment Service has made.

Martin has a lifelong intellectual disability, lives in an LSS home, has a good husband and participates in daily activities.

Nevertheless, the Swedish Social Insurance Agency withdrew his activity compensation in January 2018 on the grounds that Martin has the ability to work.

Forced to apply for maintenance support

For two years, Martin was completely without income and he was forced to apply for maintenance support in order to pay for food and rent.

Martin's good man Britt-Inger Andersson helped Martin appeal the decision, but it was a long process.

Only after two years did the Swedish Social Insurance Agency get a lesson and Martin got his compensation back.

The court found that Martin does not have the ability to work and he is therefore entitled to activity compensation.

- Then we got it right and it felt so good.

Martin has felt so bad about this, says Britt-Inger Andersson, who is a good man for Martin and helps him with his finances and with all the trips with the Swedish Social Insurance Agency and maintenance support.

The Swedish Social Insurance Agency is going against the court

But a month ago, a new decision came from the Swedish Social Insurance Agency.

Now the activity compensation is deducted - again.

With the motivation that Martin now has the ability to work and should be able to get a job.

- It is only a year since we received the sentence.

Försäkringskassan: "If we have made a mistake, we will correct it"

Försäkringskassan's area manager replies that Försäkringskassan does not have to follow the ruling in a new application.

The ruling in Martin's case was valid until November 2020. Försäkringskassan decided to withdraw the compensation in December 2020.

"Every application must be handled as a new and unconditional examination", writes Ingeborg Watz Forslund to SVT.

But the answer still indicates that the Swedish Social Insurance Agency may fluctuate when it comes to Martin's compensation.

The area manager writes that she cannot see "that there is any additional information in his case that has been added that shows a work ability".

She also writes: "The case is now being investigated within the reconsideration and I do not want to precede that assessment, but if it turns out that we have made a mistake, we will correct the previous decision."
