Mainz (dpa / lrs) - According to its own statements, the Rhineland-Palatinate Family Ministry has suffered a defeat before the Higher Administrative Court in a legal dispute over a vacancy.

The decision in favor of an applicant means “that the position may temporarily not be filled with the person who had been selected for this”, the ministry announced on Wednesday evening.

The filling of positions in ministries in the country has become a political issue since September last year.

At that time, an OVG ruling became known in which, following a complaint by an official, the transport practice in the Ministry of the Environment was described as “grossly illegal”.

It was about the waiver of tenders and an assessment of officials in the case of promotions.

On November 25th last year, Environment Minister Ulrike Höfken (Greens) announced her early resignation at the end of the year.

In a parliamentary question, the CDU parliamentary group asked for further vacancies in ministries and announced a legal opinion after the state government's response.

In the now decided "competitor dispute," the Mainz Administrative Court initially rejected the unselected applicant's application for a position in the Ministry of Family Affairs, according to the Ministry.

In the next instance, the OVG in Koblenz followed the applicant's complaint.

The reason for this is the formal error that the staff council, which had agreed to the hiring at the time, had failed to refer to the appointment again.

"We very much regret the mistake," said the ministry.

As a consequence of the judgment, the selection decision will be made again, taking into account the decision of the OVG.

Family Minister Anne Spiegel (Greens) took over the position of the resigned Environment Minister Höfken at the beginning of the year.

As the successor of State Secretary Thomas Griese, who has also retired, Ulrich Kleemann is primarily responsible for changing the promotion practice in the ministry.
