Göttingen (dpa / lni) - After the stopped deportation of a suspected Islamist threat from Göttingen, the city is considering a complaint with the Lower Saxony Higher Administrative Court in Lüneburg.

According to the judgment of the administrative court, the city is in exchange with the Ministry of the Interior and is examining the facts, city spokesman Dominik Kimyon said on Tuesday.

"There is still no decision."

The administrative court in Göttingen ruled on December 22nd that the man, classified by the security authorities as an IS sympathizer, may not be deported to Turkey for the time being.

(Ref .: 1 B 13/20).

The 30-year-old was born in Germany, but only has a Turkish passport.

In 2018 he moved to Göttingen.

The Interior Ministry considers him to be an Islamist threat.

According to the court, the man's interest in staying outweighs the state's interest in deportation.

The board pointed out that the man had so far only been sentenced to fines and a suspended prison sentence that had been more than seven years ago.

He was born in Germany and has had an unlimited right of residence since 2006.

According to the court, the man has roots in Germany, his entire Turkish family and a minor child with German citizenship live there.

His interest in staying is therefore heavy in the overall balance.

In January 2020, the Federal Administrative Court stopped a so-called dangerous deportation by the Interior Ministry because the judges did not see any current terrorist threat from the man.

The city of Göttingen, as the generally competent immigration authority, ordered the expulsion of the man and justified this with his delinquency and particular danger.

The man defended himself against this with a lawsuit at the Göttingen administrative court and was successful.
