Potsdam / Karlsruhe (dpa / bb) - Even after the second conviction of the former NPD politician Maik Schneider for setting fire to a gym in Nauen (Havelland), the case continues to concern the judiciary.

For February 25, the Federal Court of Justice (BGH) has set a date for the main hearing against the judgment of the Potsdam Regional Court, as a spokeswoman confirmed on Tuesday.

According to Schneider's defense, the summons had previously been sent to him.

Schneider had appealed against the judgment of the Potsdam court of October 2, 2019.

From the point of view of his defense lawyer, lawyer Sven-Oliver Milke, the court did not give sufficient reasons, among other things, for the arson at the gym.

The public prosecutor's office also appealed against the judgment.

According to the BGH spokeswoman, the prosecution criticized the formation of the total sentence of nine years and one month for burning down the planned refugee accommodation and other criminal offenses.

The proceedings against Schneider, who was released in January 2019 after almost three years of pre-trial detention due to excessively long proceedings, continue to drag on.

In most cases, the BGH decides on revisions by resolution.

There is rarely a main hearing - according to the court in five percent of the cases.

The parties will be heard again in the upcoming negotiation.

"I assume very firmly that after the hearing the matter will be referred back to the regional court," said lawyer Milke.

"If the defense were hopeless, they would not have invited us."

Schneider had already been sentenced to nine and a half years imprisonment in February 2017 by the Potsdam Regional Court for the arson he had admitted to the gymnasium in August 2015.

However, the BGH overturned the judgment because a lay judge was biased from the judges' point of view.

This was followed by the second trial before the Potsdam Regional Court.
