Wiesbaden (dpa / lhe) - After the delayed start of the investigation committee in the Hessian state parliament on the Lübcke murder case, a specific schedule should now be in place until Easter 2021.

Since the Higher Regional Court (OLG) Frankfurt has given the committee access to the files of the criminal proceedings, work could now begin with the “essential things”, said committee chairman Christian Heinz (CDU) of the dpa in Wiesbaden.

There was a dispute between the committee and the OLG as well as the Federal Public Prosecutor about the release of the files.

The authorities initially wanted to send the files to the U Committee only after the main hearing had ended.

The taking of evidence in the proceedings was completed shortly before Christmas.

"It could have been a little faster," said Heinz.

However, the committee has used the time since it was constituted in June 2020 and has already achieved a lot.

Among other things, the members had agreed on procedural rules, and the security rules should soon be adopted.

Some files, for example from the city of Kassel or the Ministry of Justice, are already available.

Heinz expects that the particularly important files from the criminal proceedings against the German Stephan Ernst will now be available in January.

As soon as the members have familiarized themselves, the schedule can be fixed.

Heinz pleaded for concentrating on the main task of the body, namely whether there had been any mishaps with the authorities when dealing with suspected right-wing extremists.

Ernst had confessed in the OLG process to have shot the Kassel District President Walter Lübcke (CDU) in the summer of 2019 on his terrace.

The motive should have been statements by Lübcke, who had defended the admission of refugees.

The Federal Prosecutor's Office calls for a life sentence with subsequent preventive detention.

In connection with the murder investigation, there is criticism of the security authorities.

The focus is on the alleged main culprit.

Ernst was on record as a right-wing extremist, but at the time of the crime, he was no longer under special observation by the Office for the Protection of the Constitution, he was considered "cooled down".

The U-Committee was set up with the votes of all six parliamentary groups.

The request came from the opposition factions of the SPD, FDP and Left.

"After a five-month dispute, the 5th Senate at the Frankfurt Higher Regional Court decided to finally make the trial files available to the investigative committee," said the chairman of the U-Committee, Hermann Schaus (left faction).

"When the files will actually arrive in the state parliament is still uncertain - this obstruction of the investigative work remains a sad fact."

It is to be expected that the first witnesses can only be heard after Easter 2021.
