The man wanted the municipality to pay him SEK 937,042 in compensation for the financial damage the placement in a special school entailed for him.

The largest part of the amount refers to the loss of income that the man believes he received as a result of the placement because it meant that his schooling was delayed.

After first attending upper secondary special school, the man began regular upper secondary education, which he completed at the age of 26.

He believes that the investigation carried out in 2002, which showed that he had a mild developmental disorder, was deficient.

In his action, the man referred to a later psychological investigation, which was done in 2011, and it instead showed that he had no mild developmental disorder.

Must pay court costs

Eskilstuna municipality claims that the latter investigation is irrelevant because it was not available at the time of the decision and that the municipality did not make a mistake because they acted on the basis of the decision basis that was available.

Eskilstuna District Court follows the municipality's line and concludes that the municipality has not acted negligently or negligently and that the man is not entitled to damages.

According to the verdict, the man will now have to bear the municipality's legal costs, a sum of SEK 204,965.
