She indicated that she filed a lawsuit last year to prove alimony before the Personal Status Court, and the court ruled for her to oblige the husband to provide an independent house and pay 1000 dirhams per month for her, 2000 dirhams for their child, and to provide their life expenses and house requirements at a value of 2000 dirhams, and buy gold for her worth 40 thousand dirhams. She added that after obtaining the verdict, her husband accused her of embezzling cash from him, even though he asked her to keep that money in her private bank account, and then he filed a lawsuit against her on charges of embezzlement to harm her.

She pointed out that she tried to be patient with the damage inflicted on her, and was no longer able to bear it, fearing for her life and the life of her daughter, asking for her to be divorced by divorce, for proof of custody of her child and forcing him to pay fees, expenses and attorney fees.

For her part, the husband's defense attorney, Hanan al-Bayadh, indicated that disputes occur daily between spouses, and a house is not without disputes and quarrels, given the pressures of life, and does not require division, divorce, destruction of a legitimate home and a marriage that yielded a child.

She added that her client refused, before family directives, to take off his wife, because he loved her, and wanted him to stick to her and their daughter, and that he could not dispense with them, and that he was not satisfied with the khula '.

Regarding the wife’s giving up the deferred dowry, the maintenance of the waiting period, and the fun in exchange for taking it off from her husband, Al Bayadh explained that the wife does not deserve the pleasure, nor the alimony, because it is not permissible for her to give up something that she does not possess.

She pointed out that the wife's misdemeanor court conviction on the charge of misappropriating her husband's money indicates that she is not worthy of custody of her child, and the husband has what is suitable for raising the child in custody, which is his mother and two sisters, as one of the conditions for dropping custody according to the law is that the custodian has the mind, adulthood, trustworthiness, and the ability to raise, maintain and care for the child And safety from serious contagious diseases, and not to be preceded by a judgment of crimes committed against the show, since conviction of a wife with a case of embezzlement necessitates dropping her custody of her minor child.
