Gelsenkirchen (dpa / lnw) - The termination of six miners of the disused coal mine Prosper Haniel in Bottrop by the mining company RAG is ineffective.

The State Labor Court (LAG) Hamm confirmed a corresponding decision by the Gelsenkirchen Labor Court from January in an appeal on Tuesday, "in full", as a spokesman said.

A revision was not allowed.

The six miners would be in an ongoing employment relationship and would be entitled to so-called default wages.

The Gelsenkirchen Labor Court had justified its decision, among other things, with the fact that the general works council and not the local works council would have been responsible for the reconciliation of interests agreed between the employer and Prosper-Haniel works council in March 2019.

RAG announced the terminations at the end of 2019.

In a statement, RAG reiterated its view that the dismissals that have been pronounced are legal.

The RAG will therefore examine the possible legal remedies against the judgments of the regional labor court Hamm, it said.

According to the court spokesman, a non-admission complaint is possible.

The miners' lawyer, Daniel Kuhlmann, assumes that the LAG will declare the terminations ineffective in the other pending proceedings.

The court put the number at around 145.

Judgments are to be made in January, February and March in the proceedings, which are distributed among several chambers.
