Events: Arrested the two brothers accused of shooting their brother-in-law in Chamberí for a family revenge
A popular jury of the Provincial Court of Madrid has declared the brothers
Javier and Guillermo Fernández Flores
guilty of the murder of
Luis Romero Durán
, known as
Luisito
, who died on April 6, 2018 after being shot and killed shortly after leaving the office of lawyer
Marcos García Montes
in Chamberí, legal sources have informed Europa Press.
The crime was attributed in the police and judicial investigation to
a
family
vendetta
.
It occurred three days before the trial in which the deceased was going to be tried for the death of the Fernández brothers' father, which occurred in 2015 in an industrial estate in Arroyomolinos.
At the time of the murder,
Luisito
had just had an appointment with one of the lawyers from Marcos García Montes's office to prepare the oral hearing.
As soon as he left and accompanied by his parents, he was riddled with gunshots.
He died in the arms of his father
.
The verdict, which was made public last Wednesday, comes after more than a month of sessions in which the jury court has been able to hear
key testimony
that would undermine the presumption of innocence of at least two of the three defendants.
The members of the jury court have considered the brothers who allegedly fired the shots authors of the
crime of murder and illegal possession of weapons
.
Despite ruling Javier and Guillermo guilty,
the jury has determined to exonerate another of the brothers
who had sat on the dock for allegedly helping them flee from the crime scene.
The woman and the mother of the victim were summoned to the trial, who witnessed the events.
However, they did not attend the court summons for fear of the
threats received
.
During the trial, one of the agents who instructed the statement said that
Luisito's wife "fully" identified her brothers at the crime scene
as the perpetrators of her husband's murder.
"They have been my brothers," the witness shouted as soon as the National Police arrived at number 3 of Fernando el Catolico street.
Both
families facing each other
, the Romero and the Fernández, belong to the
mercheros
or
quinquis
, an ethnic group of their own and who are not identified as half non-gypsy, half gypsy.
Javier and Guillermo Fernández face a prosecutorial request for 31 years in prison, while the victim's family raises the sentence to 36 years.
For the other brother, 9 years and 9 months in prison were requested as a necessary cooperator of the crime.
But he will be acquitted according to the popular verdict.
DEATH TO SHOTS
According to the prosecutor, the brothers Javier, Guillermo and Juan Fernández knew that their sister, their partner and his parents were going to go to a law firm to
prepare a trial that was to be held days later
.
In that oral hearing
, the murder of the father
of the three brothers, Juan FS, in which his daughter Yolanda FL, his partner Luis RD and his parents, Rafael RM and Yolanda DP were accused.
The three people who will sit on the dock of the accused arrived at Fernando el Catolico street in Madrid where the lawyer's office was located and parked their vehicle at number 4 of the aforementioned street "where they
waited
to avenge the death of their father.
the most propitious moment to end the life of his brother-in-law Luis Romero Durán ".
Thus, around 6:18 p.m., and when Luis Romero Durán left the interior of the Villa de Narcea bar located in front of the law firm, "a place where his family members were still paying for the drinks," Javier and Guillermo
approached from behind to the victim
while his brother Juan was waiting for them in the car to facilitate their escape, and less than two meters away they
fired "at least" four shots
, of which two hit Luis Romero Durán.
Upon hearing the shots, the relatives of the victim who had been lying on the ground left the bar and tried to snatch the gun he was carrying from Guillermo and with which he
"pointed at Luis's head with the intention of shooting him
.
"
Immediately afterwards, the parents of the deceased and the sister of the accused had a struggle with Guillermo and Javier "in the course of which both women Yolanda F. and Yolanda D.
managed to lower the scarves, panties with which they hid their faces
."
While Yolanda F. was lying on the inert body of Luis, her brother Guillermo placed the gun "that was still hot from the shots" on her back while saying:
"Let you know that the next one is going to be your son"
to then hit him on the head with his pistol.
During the
struggle
, both defendants beat Rafael R. and Yolanda D. with their respective weapons "causing this blunt incised wound of 2 cm in diameter in the interparietal region with irregular edges."
Moments later the two brothers ran to the place where they had parked the vehicle "being pursued by Rafael Romero who could not catch up with them and they got into it where, as agreed,
their brother Juan was waiting for them at the wheel
", affirms the Prosecutor's Office.
After fleeing, around 6:42 pm they
abandoned tourism on Stockholm Street "and burned it
to erase any vestige in it that related them to the events perpetrated."
