The court required the telecom company to return him to the husband

A legal dispute between a woman and her ex-husband over a phone number

The Abu Dhabi Court of First Instance required a telecommunications company to return a phone line with a distinctive number to a man again, after his divorced woman transferred his ownership to her name, according to an agency that was granted to her, taking advantage of his six-month imprisonment in a criminal case.

The court confirmed that the agency granted by the husband to his divorcee during their marital relationship allows her to conclude contracts, except for contracts that transfer ownership.

In the details, a man filed a lawsuit in which he demanded that his divorcee be compelled to return his phone number and return it to him and register it in his name, indicating that the defendant was his wife and gave her a public power of attorney, then disputes occurred between them, and he was arrested for six months pending a criminal case, and during his imprisonment The agency used the transfer, assignment and transfer of ownership of the phone number to it, registering it in its name without his knowledge, and providing a document for his claim, a copy of the phone ownership transfer form to it and a copy of the VIP package application form.

The prosecutor confirmed that he canceled the agency, but it was in effect when his divorced woman transferred the ownership of the phone, pointing out that the constant of the communications sent from that number were his own communications indicating his possession of it, and he requested the inclusion of the company that owns the line in the lawsuit and obliged her to submit a statement of the calls issued in it before his imprisonment. The company demanded that it be rejected due to its lack of capacity in the dispute.

With the question of the defendant, she confirmed that she had transferred the line to her name, noting that she had previously bought this line from the brother of her divorced woman for 68,000 dirhams, and that she handed the amount to her divorced woman, but her ex-wife asked at the time to register it in his name, and she did not mind that, and the plaintiff used it until she transferred it in her name. And after moving the line, she did not use it so as not to receive any incoming calls to the plaintiff, and that the previous owner of the phone (the brother of her ex-husband) died.

The court accepted the inclusion of the company that owns the line in the lawsuit, noting that the agency granted to the defendant is a general power of attorney issued by the plaintiff to the defendant, and its first clause guarantees its representation of the plaintiff in a request to transfer, cut, cancel or renew the regular and mobile phone lines, faxes, mail and the Internet, but the third item Some of them related to contracts stipulated that they may conclude all contracts except for contracts that transfer ownership.

She explained that the disputed phone line is one of the distinctive numbers and is subject to ownership, and that the company has accepted the transfer of its ownership to the defendant beyond the scope of the agency granted to it without a legal basis that allows them to do so, and the court ruled obligating the company to return the phone number to the husband and re-transfer his ownership and register it in his name, while obliging his divorcee And the company that owns the line with fees and expenses and attorney fees.
