The Public Prosecution indictment stated that the accused falsely and in bad faith informed a police station that his wife had violated the sanctity of his home, stole money, official papers and a car, and that his daughters and maid had been kidnapped, despite his knowledge of her innocence, with the intent to harm her, as well as throwing the victim with something that would outrage her.

The regulation stated that the accused had violated the safety of his daughters and the servant who was incapable of carrying out their personal work for a period not exceeding 20 days, and the victims had also threatened to infringe on their safety, and had become accustomed to violating the integrity of their bodies beyond the prescribed limits of discipline, which would affect their emotional and psychological balance, Demand that he be punished in accordance with the amended penal code and the Child Rights Law.

She added that the accused's claim that his wife has kidnapped his daughters is just an accusation that turns out to be unfounded, and this is what the court concludes with him that his intention to harm the victim by directing accusations and attributing actions to her knowing in advance that she did not commit them.

She added that the accused's denial of the charges against him and his claim to the veracity of the communication is an answer to him, and if the complaint, grievance, and litigation is guaranteed to every person, then this does not mean the claim is void against others, which requires criminal prosecution.

She indicated that the rest of the charges assigned to the accused remained abstract and lacked definitive evidence and irrefutable arguments, as they were sent and were not supported by technical evidence from medical reports or inspection of the effects of his beating on his daughters.

She stated that in light of the differences between the accused and his wife, it is not reasonable or logically conceivable that a wife would be subjected to beating and insulting in an open manner several times without filing a complaint against him, even though she had previously filed a divorce case, and regarding what was attributed to the accused of relying on cruelty to his daughters and his habit of assaulting them This is not proven in the case and there is no evidence to confirm that the incident took place, and that the statements of his daughters cannot be the only evidence of accusation, which is what the court decides to fine the accused 10 thousand dirhams for the incident of the false report, and his innocence of the rest of the charges due to insufficient evidence, and obligating him to pay the due fee .
