The current crisis has prompted the Ministry of Labor to establish a health protocol for the reception and monitoring of employees at their workplace.

For example, the employer is encouraged to systematically check the temperature at the entrance to the establishment, as lawyer Roland Pérez explains on Europe 1.

DECRYPTION

Due to the new confinement in the face of the coronavirus, the Ministry of Labor has revised the national protocol for the protection of employees.

The employer must therefore encourage his employees to download the #TousAntiCovid application and even to take screening tests.

What is it really ?

Lawyer Roland Pérez examines these crucial questions in view of the current health situation.

In reality, the employer has the role of initiator and informant in the face of this unprecedented crisis.

The protocol which frames the rules for the protection and safety of workers recommends that the company manager communicate on the #TousAntiCovid application and on the value of activating it during working hours, in particular for the alert.

Appointment of a "Covid-19 referent"

To encourage downloading, the digital travel certificates are in the application, in order to go faster when you have to leave your home.

This application is all the more essential in companies for the traceability of contact cases.

In companies, there is what is called a "Covid-19 referent", when it is not the manager himself.

Systematic temperature control at the entrance to the establishment is thus provided for as part of the non-compulsory but recommended measures.

There is, as a bonus, a request for collaboration from companies in the screening of Covid-19, by offering volunteer employees PCR tests.

Soon, if not already, antigenic tests will be offered.

Less reliable than PCR tests, they have the advantage of giving a result within 30 minutes of the nasopharyngeal sample.

Protected medical confidentiality

The health protocol established by the Ministry of Labor clearly specifies that medical confidentiality must be preserved.

In this case, no test results can be communicated to the employer (or employees).

The same goes for taking the temperature: the employee can refuse it.

In this case, if the employer refuses his access to the company, he must continue to pay him.

No entry of the temperature taken from employees or visitors may be entered in a paper or computer register.
