According to a temporary law, those who want to obtain a permanent residence permit must be able to show a secure livelihood, for example having a permanent job or being self-employed.

Persons with probationary employment, a relatively precarious form of employment, have thus not previously been granted a permanent residence permit.

But now there may be other commandments.

The Swedish Migration Agency assesses that in "some cases it may be possible to obtain a permanent residence permit even though you have a probationary period", the authority writes on its website.

The precondition is that it is clear that the probationary employment will be transferred to a permanent employment.

Individual assessment

“We mainly see that our new governance means that we will make an individual assessment, which can make a difference in certain cases.

A guide that comes from, for example, the Migration Court of Appeal in recent years clearly goes against giving a greater scope for the individual assessment within the given framework ", writes Daniel Grynfarb, unit manager at the Swedish Migration Board, to TT.

Maria Malmer Stenergard, the Moderates' migration policy spokesperson, is "very surprised and deeply concerned".

- What surprises me is that there is nothing in the legislation that has changed, but now all of a sudden it is enough with probationary employment anyway, she says.

"Erodes trust"

More people than was originally intended will now receive a residence permit through probationary employment, when those who really need to be given priority are people who have the greatest need for protection, according to Malmer Stenergard.

- This means that we erode trust in our migration legislation to an even greater extent.

You send signals that as long as you cling on, it is enough to get a permanent residence permit in Sweden, she says.
