(28), accused of broadcasting a sex video in which the first two participated with a woman in 2016. On the early morning of April 18 to 19 of that year, Enrich and Luna (then players of the Eibar Sports Society) maintained relations sex with a young woman from Gipuzkoa they had met.

By mutual agreement, although without her consent, they recorded the trio and, the next morning, they forwarded the video to his former teammate, Eddy Silvestre.

According to the indictment, he was the one who forwarded the recording to various contacts through a mobile messaging group, which caused it to go viral a few months later, in October.

A couple of weeks ago the oral hearing took place in the criminal court number 3 of San Sebastián, where the three players involved and the victim testified.

The lawyer for this has been Íñigo Iruin, a former member of the Basque Parliament for Herri Batasuna and Euskal Herritarrok who has legally defended numerous ETA members

in various legal proceedings.

As a representative of the private prosecution, Iruin lowered the sentence requests for Enrich and Luna from five to two years in prison, after the declaration of both.

The Prosecutor's Office did the same, considering as mitigating the reparation of the damage and the repentance.

Instead, Iruin said after the hearing that

"there is no doubt" that "the broadcast was produced by Silvestre

If he is finally sentenced to the maximum penalty requested (three years), he will surely have to go to prison for at least a few months.

At trial, Silvestre did not make it clear what his actions were.

"I don't remember the exact day, but I received it," he said.

According to his statement, Enrich "used to send such videos", although he avoided his involvement.

"For me it was one more video. I saw it,

but I did not get to see it in full because I have a partner and I deleted it for fear that she would see it."

Lies and referrals

During the hearing,

Enrich and Luna confessed that they recorded the woman without her knowledge or authorization

, who at one point surprised the second with the first's mobile and warned him not to take any type of image.

The following day, in a telephone conversation with her, both players admitted that they had taken a video, but that it had been deleted.

It was not true:

a few hours later they sent the video to Silvestre, a fact that they hid from the victim.

She was aware of what had happened when, in October 2016, a coworker showed her the recording on his mobile phone, which was already circulating throughout Spain.

The woman contacted Enrich and Luna again:

"What is this? What have you done to me? Please stop it! I want you to stop it!"

he implored them.

In addition to showing their regret, Enrich and Luna

have compensated the victim with 110,000 euros for the damage caused, an amount higher than requested

For his part, in addition to the prison sentence, Silvestre could have to compensate the woman with 30,000 euros.

Enrich said during the procedure.

Luna, for her part, described the recording and dissemination of the video without the woman's consent as a "tremendous mistake": "I feel the pain that has been caused to her and her environment."

After leaving Eibar, Luna is currently a member of the Girona Fútbol Club.

Eddy Silvestre, who at the time of the events was part of the Cádiz Club de Fútbol staff and who currently plays for Albacete Balompié, considers that he has been designated as a scapegoat by his former teammates.

"Silvestre was not the only one who received the video," said his lawyer during the hearing

, who accused Enrich of "spurious interests" and described as "covert negotiation" the movements that would have led him and Luna to recognize the facts in search of of a sentence reduction.

Silvestre's lawyer denounced that during the procedure, principles such as the presumption of innocence and that of 'in dubio pro reo' regarding his client had been questioned.

"We are asking for a very serious penalty for a citizen and we must ask for it rigorously," he

emphasized.
