  • The first Frenchwoman to have lodged a complaint against the third generation pill will finally have her complaint investigated.

  • After a stroke that she attributes to taking the Méliane pill, Marion Larat filed a complaint against Bayer in November 2012.

  • The young woman, now 33, is due to be auditioned by the end of the year.

This is a victory for Marion Larat, heavily disabled after a stroke that she attributes to taking a third generation pill produced by Bayer.

The young woman lodged a complaint against the laboratory in November 2012. A complaint which will be the subject of a criminal investigation after a court decision which overturned a dismissal pronounced in 2018, her lawyer announced on Monday.

At the same time, at the civil level, Marion Larat, whose justice had recognized the quality of victim of "a medical accident not at fault", was granted by a judgment in September of the judicial court of Bordeaux, compensation of 4.5 million euros by the National Medical Accident Compensation Office (Oniam).

The victim auditioned by the end of the year

With this turnaround in a case that has been running for eight years and concerns thousands of women claiming to be victims each year of sequelae of hormonal contraceptives, the investigating chamber of the Paris Court of Appeal indicated, in a judgment in July , that "it was wrongly estimated that the causal link between the intake of (the Méliane pill) and the stroke had not been established with certainty", a source close to the case said. .

Me Jean-Christophe Coubris, lawyer for Marion Larat, welcomed the appointment of an examining magistrate, who should hear his client "by the end of the year".

At the end of 2012, Marion Larat, a 25-year-old ex-student from Bordeaux, had become the first Frenchwoman to lodge a complaint, for "involuntary attack on the integrity of the person", after a stroke in 2006 and a disability of 65% , which she attributes to a third-generation pill, Méliane, produced by the German group Bayer.

130 other complaints

At the time, the case had pushed the health authorities to anticipate the delisting of “mini-pills” and paved the way for some 130 other complaints, centralized at the public health center of the Paris prosecutor's office.

But in 2017, the prosecution classified the investigation into 29 brands of third and fourth generation contraceptive pills.

Marion's lawyer then lodged a complaint with a civil party, leading to the appointment of an examining magistrate, but a dismissal order had been issued in October 2018, hence the appeal from Me Coubris.

In the wake of the Marion Larat affair, the climate of mistrust of third and fourth generation pills led to dramatic drops in sales.

And the publicized fight of the young woman "for the other victims", had earned her a prize "Woman of the year" (France2 / RTL / Marie-Claire).
