A (Asian) maid filed a lawsuit before a full civil court, demanding that her sponsor (Gulf) and the Auxiliary Labor Recruitment Office be compelled jointly to pay the accumulated fines of nine thousand dirhams and obligate them to hand over her passport, as the case was referred to the civil court, and the first defendant handed the plaintiff to the court 520 dirhams in the salary of last July, so the plaintiff waived his litigation and demanded that the second defendant be obligated to the Auxiliary Labor Recruitment Office to pay her 2,700 dirhams in residency fines and to hand over her passport.

The attorney of the office denied before the court that he had received sums of money from the plaintiff, and decided that the office was not responsible for the plaintiff’s residency fines. He handed her her passport. The plaintiff has attached evidence of the accumulation of residence fines on her, amounting to 7125 dirhams.

The verdict states that in the event that the plaintiff left the litigation of the first defendant, the employer, to accept the waiver of the litigation, he must express his agreement to the assignment, and if he does not express his approval, the court does not consider that assignment, and the first defendant is considered a litigant in the lawsuit .

She explained that the plaintiff’s request to oblige the second defendant to the assistant labor recruitment office to pay the delay fines resulting from obtaining a residency permit that allows her to work, as it is decided according to the text of Article Six of the Ministerial Resolution regarding specifying the rules and procedures to be followed in granting work permits with regard to the recruitment of workers. The employer is obligated to sponsor the worker and his responsibility to bear the expenses of his employment and to take the necessary measures to prepare and sign the work contract, including obtaining the residency and canceling it

She indicated that it was clear to the court that the first defendant, the employer, is obligated to take the residency procedures and pay its expenses because he is entrusted with extracting the residency for his servant, and he is bound by fines for not extracting the residency, as his mistake is not to extract it on time, and the second defendant is not responsible for the labor recruitment office. Responsibility as a mediator to bring the plaintiff to work for his clients.

She added that the first defendant is obligated to pay residency fines as her employer and sponsor, and based on him the court requires the first defendant to pay fines estimated at 7125 dirhams, as stated in the affidavit received from the Federal Authority for Citizenship and Residency and any new developments until the plaintiff’s residency is extracted, as it ruled. The court obliged him to pay the expenses, and exempted the plaintiff from the expenses of the remaining requests.
