The former president of the Generalitat of Catalonia

Artur Mas

has sent a letter to the National Court in which he assumes "personally" responsibility for the appointment of treasurer

Daniel Osácar

and admits that he was "accountable" to him as Secretary General of

Democratic Convergence of Catalonia

(CDC).

At the same time, in this document, to which EL MUNDO has had access, he

exonerates

his historic right-hand man,

Germá Gordó

, who has just been indicted by Judge

José de la Mata

for participating in the laundering of black money to irregularly finance the nationalist party.

"At no time did Gordó propose that person to me," he underlines in reference to Osácar, who has just confessed to the illegal financing of the CDC and has implicated the former leadership of the training after agreeing with the

Anticorruption Prosecutor's Office

for his collaboration to clarify the acts.

The recent confession of the former head of the CDC finances, carried out in a separate piece of the

3% case

, has pointed directly to Gordó as responsible for the

smurfing

-income

fractionation-

in the coffers of political formation and has caused his citation as investigated by the judge.

But also the unexpected reaction of Mas, whom Osácar has in turn left one step away from the indictment after pointing out that he knew about this variant of the irregular financing of the nationalist party.

The former president has decided to immediately come to the rescue of Gordó and has provided him with a record of demonstrations in which he exonerates him from the ultimate responsibility in matters of finances at CDC.

This document has already been contributed to the judicial procedure by the lawyer of the former

Catalan Minister

,

Cristóbal Martell

.

"According to the CDC statutes, in force in 2005, the competence to propose the person in charge of Finance, as well as the manager [position that Gordó held], corresponded to the general secretary of the CDC, a position I held at that time" , begins by explaining More.

"In accordance with the same statutes, I proposed Mr. Daniel Osácar i Escrig, who was appointed head of Finance by the National Council of the party."

"Proposing Osácar was a personal decision of mine and, at no time, Mr. Germá Gordó i Aubarell proposed me to that person," he emphasizes.

Likewise, Mas adds that "the head of finances and the CDC manager depended, each, at that time [2004 to 2010] directly on the secretary general."

"Therefore, neither the person in charge of Finance depended on the manager nor the manager of the person in charge of Finance," he clarifies.

"The two had different powers and were accountable to the CDC Secretary General, the CDC National Executive Committee and the CDC National Council," he added.

Fake donations

Mas's letter was prepared immediately after hearing the content of Osácar's statement before Judge De la Mata.

In his appearance, he maintained that Gordó was "the person who directly and personally devised the operation" known as

smurfing

as well as who "planned and directed its implementation."

This mechanism, discovered in the CDC by Anti-Corruption with the prosecutor

José Grinda

in charge, consisted of laundering the party's black money through false anonymous donations made in small amounts that were entered into the party's accounts.

The companies that participated in this irregular financing scheme sought, according to Judge De la Mata, "to benefit from public contracting or to ingratiate themselves with the party leaders."

In this way, the nationalist formation resorted to businessmen and trusted persons to carry out "donations of 3,000 euros by nominative bank check in exchange for receiving the same amount of cash of illicit origin."

Osácar said that Gordó gave him the list of potential donors who were going to lend themselves to the

Smurf

so that he would call them and give them the black money they had to launder.

The judge asserts that at the end of the operation, Osácar "personally and hand delivered the excess amount to Gordó," which he was summoned to declare on October 30.
