• Courts: Justice ratifies the sanction to Echenique for keeping his assistant without a contract

The spokesman for United We Can in the Congress of Deputies, Pablo Echenique, will have to definitively pay 11,040 euros of sanction to Social Security for the irregular hiring of his assistant.

Echenique has withdrawn from the cassation appeal that he presented in the Supreme Court at the end of 2019 against the sentence handed down months before by the Superior Court of Justice of Aragon (TSJA).

Official sources of the Supreme Court, which Heraldo.es cites on Tuesday, have confirmed that the politician has made this decision before it has ruled on whether or not to process the appeal.

In this way, Echenique will have to face the economic sanction imposed by Social Security, which found that there was an employment relationship between the politician and the worker and, therefore, breached the law by not having him registered.

The file that was opened to him ended with a settlement certificate for 1,039 euros, to which was added a fine of 10,001 from the Labor Inspection for considering that he committed a very serious offense.

Black payments

It was confirmed that Echenique paid his assistant "in black" in two periods, from September 2011 to June 2012 and from March 2015 to April 2016.

The aforementioned sanction is limited to the second stage, since more than four years had elapsed since the first legal breach, which had prescribed.

In October 2017, the General Treasury of Social Security appealed to the courts and the Social Court number 2 of Zaragoza agreed with it in the first instance in January 2019.

The court understood that if it had been a provision of services between Echenique and his assistant, invoices should have been issued, but the politician did not provide any.

Therefore, the judge ruled that he should have registered his assistant in the domestic workers scheme, in which workers who take care of dependents contribute.

The parliamentary spokesman for United We Can then appealed to the TSJA, which in September 2019 rejected all the reasons for his challenge.

Through his appeal to the Supreme Court, the politician requested the "unification of doctrine", since his defense argued that there was another judgment of the Superior Court of Madrid of a different nature on a case that he understands is similar.

However, it has now withdrawn from proceeding with the appeal, without explaining the reasons for its decision.
