The administrative judge, seized in the context of an interim relief, considered "that it had not been demonstrated that a total closure was necessary, appropriate and proportionate to the aim pursued in the fight against the spread of Covid-19", indicates the administrative court in a press release.

29 establishments referred the matter to the summary judge

By a decree of October 12, the prefect ordered the closure of bars in Toulouse and 16 suburban municipalities, imposing certain additional health measures on the passage to restaurants, in particular the limitation of groups to 6 people.

Thursday, 29 establishments seized the judge of summary proceedings, reporting the economic consequences of this decision, which endangered "the viability of the establishments concerned", or "nearly 2,000 for more than 13,000 employees".

"No source of contamination" in these establishments

The summary judge considered that these establishments "are subject to a strict and controllable sanitary protocol, and it does not appear that it would not be respected", also noting "that no source of contamination is (there) been detected, "the press release further indicates.

In his decision the magistrate specifies "that the announced curfew is likely to respond to the deterioration of the health situation".

In addition, the same court on Friday suspended another prefectural decree which ordered the closure of a Toulouse casino belonging to the Barrière group.
