Courts Javier Guerrero dies, one of the main defendants in the 'ERE case'
The sentence. Sentence of the ERE: six years in prison for José Antonio Griñán and nine years of disqualification for Chaves
How will the death of
Javier Guerrero
, one of the main defendants in the ERE corruption case,
affect the
infinity of open cases and detached from the macrocause?
It is the main unknown that now hangs over the cases that the Court of Instruction 6 of Seville continues to investigate and others already instructed who are awaiting their turn for the trial to be held at the Hearing. Some lawyers consulted by EL MUNDO believe that, in theory , Guerrero's death
should not affect too much
siado
and that pending trials should be held.
Other lawyers, on the other hand, do believe that the absence of the former director general of Labor and Social Security from the Board could mean
a serious setback
To bring these causes to fruition, one of them is the one that must prosecute the aid that Javier Guerrero granted to the companies known as the 'coca' driver,
Juan Francisco Trujillo
, which received funds from the EREs amounting to
1,475,028.01 euros
.
Part of that public money was allegedly used in the
buying gifts and cocaine
It is one of the darkest episodes that has surrounded Guerrero during these years.
Juan Francisco Trujillo testified on March 16, 2012 before the judge
Mercedes alaya
who came to spend up
25,000 euros per month
in the purchase of cocaine for his own consumption and that of his boss with the money from the Board's public aid that his companies received irregularly.
According to the former driver's testimony, Guerrero would also have received between 60,000 and 80,000 euros in cash, paintings,
a piano, antiques
, clothes worth 2,000 euros and a thousand euros more in mobile phone consumption.
Many of these gifts would have been taken to his home in El Pedroso by the former driver himself.Guerrero always denied this accusation of the driver, which he attributed to
a "rematch"
of this for having asked to be set aside as a driver for "repeated non-compliance at work" and for the way in which "lately he had been dressed."
"Jovial, but not whore"
When the former director general was questioned in the Andalusian Parliament on this matter, he stated: «All I am saying is that I consider myself a jovial person, I have not been a whore or have dedicated myself to
drug addiction
, which is not on my land, I am dedicated to other things.
[...] I know how much a packet of Marlboro and a
gin tonic
, and that's it.
I have not bought a joint, I have not needed it ». The Anti-Corruption Prosecutor's Office complained
14 years in prison and 30 years of disqualification
for Javier Guerrero and his driver Juan Francisco Trujillo for continued crimes of falsification, prevarication and embezzlement of public funds, in relation to irregular aid worth 1.4 million Months ago, Guerrero was excluded from numerous pieces detached from the ERE, applying the legal principle
non bis in idem
, what
prevents being tried twice for the same cause
This former high-ranking official has already been tried and
sentenced to 7 years in prison
by the Seville Hearing in what is known as the 'political piece' of the ERE in which 19 former high-ranking officials were convicted, including former presidents Chaves and Griñán.
