  The "Opinions on Strengthening Cooperation and Cooperation in Prosecuting Public Interest Litigations to Ensure Food and Drug Safety in accordance with the Law" (hereinafter referred to as the "Opinions") is jointly organized by the Supreme People's Procuratorate of China, the Office of the Cyber ​​Security and Informatization Commission of the Central Committee of the Communist Party of China, and the Office of the Food Safety Commission of the State Council of China. It was printed and distributed, clarifying 19 issues in 7 aspects, including the transfer of clues to public interest litigation in the field of food and drug safety prosecution, jurisdiction over case filing, investigation and evidence collection, pre-litigation procedures, litigation, daily contact and personnel exchanges.

  The person in charge of the Eighth Prosecutors Office of the Supreme People’s Procuratorate of China said that the "Opinions" establish a mechanism for the transfer of public interest litigation clues, consultations and judgments, and information sharing, standardize the procedures and mechanisms of procuratorial organs for handling cases, improve the coordination and cooperation mechanisms in the process of investigation and evidence collection, and clarify administration Law enforcement agencies shall implement the standards of due diligence, establish and improve the daily contact mechanism and personnel exchange and training mechanism.

  The "Opinions" pointed out that the relevant food and drug departments have a strong reaction from the people, bad social impacts, and high public opinion on matters that occur in campuses and surrounding areas, catering clusters, agricultural wholesale markets, and other areas involving infant food and drugs. If clues to public interest litigation cases involving infringement of food and drug safety are met with resistance or require coordination among multiple departments, they should be promptly transferred to the procuratorial organ for handling.

  The "Opinions" also proposed to explore the establishment of a jurisdiction notification system in administrative public interest litigation.
