A man filed a lawsuit against his wife before the Personal Status Court in Ras al-Khaimah, demanding his divorce due to harm, the dropping of her rights resulting from the marriage contract, and dropping her custody of her child.

In the details, the prosecutor said that his wife does not respect him and attacks him by saying, and exposes his family to insults and does not obey his orders, in addition to that she always leaves the house without his consent, and puts the life of his child at risk as she takes him to another emirate despite the spread of the Corona virus.

For its part, the defendant stated, in the lawsuit newspaper, that the plaintiff is violating her by beating her and treating her as a servant in the house, and he does not sit with her at the dining table, and insults her, as the reconciliation was offered to both parties, which was rejected by the plaintiff and the defendant agreed to it.

The attorney for the plaintiff, Hanan Al-Bayadh, indicated that the defendant had consistently insulted the plaintiff and slandered in front of others, denounced him for what he was defending, insulted and oppressed, and deliberately left the marital home without his desire or consent.

She stated that Article 117 of the Personal Status Law stipulates that each of the spouses has the right to request divorce due to harm that makes it impossible for them to continue with the good, and neither of them loses their right to do so unless their reconciliation is proven. She continued that it is legally established that each of the spouses request a divorce due to harm whenever Any type of harm occurred to the other spouse, by word or deed, even if the harm was not repeated, provided that the harm was gross, whether the harm was material or moral, and whether it affected one of the spouses or their parents or their family, so long as the ten is not possible with him, and the harm is not required to be repeated .

She explained that the defendant's withdrawal of custody of her child came due to the lack of custody conditions in her, as she is unable to take care of the child, due to her desire not to be in her husband's home, and to constantly go out to another emirate in light of the outbreak of the Corona virus, and she demanded that her client, the plaintiff, be divorced from the defendant. Indicating the damage, and obligating it to pay fees, expenses and attorneys' fees.

For his part, the defendant's attorney, Dr. Raed Al-Awlaki, indicated that the plaintiff’s statements were devoid of evidence, and were a statement of flimsy and unfounded allegations, and a desperate attempt to undermine the defendant, and continued that the case papers lacked evidence to prove the plaintiff’s claim. This does not result in the annulment of the marriage contract, and his statements are considered transmitted, and there is no evidence or basis for the validity of his statements.

Article 117 of the Personal Status Law states that each of the spouses has the right to file for divorce due to the harm that makes it impossible for the family to remain in love.
