The prosecution requires a trial for three police officers -

The violence suffered by Théo, seriously injured during a police check in 2017 in Aulnay-sous-Bois (Seine-Saint-Denis), is of a criminal nature, the prosecution said.

In his final indictment, dated September 23, he requested the dismissal of the main accused before the assizes for "willful violence with a weapon by a person holding public authority resulting in mutilation or permanent partial incapacity".

He also requested the dismissal of two other police officers for the related offenses of “willful violence in assembly by persons holding public authority” and the dropping of charges for the fourth indicted.

The prosecution, on the other hand, requested the dropping of the charges for aggravated rape, considering that the elements constituting this crime - in this case intentionality - were not required.

Despite this requalification requested by the prosecution, the young man's lawyer, Me Antoine Vey, said he was satisfied with the decision of the prosecution.

"Despite the posturing in this case, the prosecution acknowledged that there were sufficient charges to recognize that the police violence of which my client was the victim are of a criminal nature and to request a trial at the assizes", he said. at

The request for referral to the assizes is linked in particular to the after-effects from which Theo still suffers today.

On February 2, 2017, Theo was seriously injured in the anal area by a telescopic baton, during a police check in the city of 3,000.

In 2019, a medical expert report concluded that this police action had caused a "permanent disability", caused by injuries in "certain and direct" relation with his arrest.

According to this report, the victim suffers from incontinence requiring "lifelong" care.

It is now up to the judges to follow - or not - the requisitions of the prosecution.
