Like Nice and Lille, but not like in Rennes.

The Marseille administrative court rejected the appeal against the prefectural decree deciding the closure of sports halls in the context of the health crisis linked to the Covid-19 epidemic, we learned on Friday.

The summary judge in fact considered that the contested ban was not manifestly disproportionate "with regard to the objective of protecting public health pursued".

And this, "despite the seriousness of the infringement it brings to the public freedoms invoked by the applicants and the significant economic consequences that it will engender".

The court based its decision on the same grounds as for bars and restaurants, which have also suffered a failure in their appeal against the prefectural closure order.

He argues in particular that these places host activities which, by their very nature, do not guarantee the implementation of measures to prevent the risk of spreading the virus.

And recalls that "on the one hand, outdoor sports or physical activities have not been prohibited" and on the other hand, that "the measures taken are intended to be reviewed on October 5, 2020".
