Transition in Mali: the junta gives up a major prerogative for its leader

In Mali, the charter that will organize the transition for the next 18 months was published this Thursday, October 1 in the Official Journal.

The document takes into account an essential requirement of the ECOWAS on the prerogative of the transitional vice-president, Colonel Assimi Goïta, head of the junta.

Unlike a previous version of the transition charter, the one


published in the Official Journal on Thursday does not mention that the vice-president can assume the functions of president of the transition in the event of force majeure.

The Malian junta therefore gives up one of a capital prerogative of its leader, Colonel Assimi Goïta, number 2 in the transition.

This is a fundamental requirement of ECOWAS for the lifting of sanctions.

But the devil is in the details.

Article 7 of the charter, which defines the powers of the vice-president in charge of security and defense matters, does not however expressly say that he may in no case ever sit in the presidential chair.

The duration of the transition is set at 18 months, according to the text, which provides that the president and the vice-president will not be eligible for the presidential election and the legislative elections at the end of the transition.

The procedures for creating the National Transitional Council, the legislative body, are also set out in Article 13. The Council will be composed of 121 members.

At its head, a soldier or a civilian will be elected.

But ECOWAS also demanded the dissolution of the junta.

On this point, we will have to wait.

The charter specifies that it will remain there until the establishment of all the organs of the transition.
