Two weights, two measures.
On Wednesday, the administrative court of Lille rejected several appeals contesting the prefectural order prohibiting the practice of indoor sport.
The measure was taken in Lille and other metropolises a week ago, after the government published a map of areas particularly affected by a rebound in the coronavirus epidemic.
According to the cities, these appeals have not received the same echo from the magistrates.
In a decree published last Friday, the prefect of the North, Michel Lalande, wrote: “On the territory of the European Metropolis of Lille (MEL), sports and physical activities are prohibited in closed and covered sports establishments.
This is one of the measures taken after the MEL was classified as an enhanced alert zone and which was to come into force on Saturday.
Two days later, appeals were filed by professional unions in the sector to request the suspension of the measure.
Appeal rejected in Nice and Bordeaux but not in Rennes
According to the prefecture of the North, the request was rejected by the administrative court.
"The closure measure in dispute [...] does not appear disproportionate with regard to the objective of protecting public health pursued", justifies the court cited by the prefecture.
The magistrate adds that these physical activities "because they are carried out in closed, covered places, promote contamination and accelerated circulation of the virus to a large number of individuals".
It is with more or less the same arguments that the courts of the cities of Bordeaux and Nice have also rejected the appeals.
On the other hand, in Rennes, classified like the MEL in an enhanced alert zone, the applicants won.
In his order, the summary judge notably considered "that in the state of the data and information submitted to the court, private sports halls could not be regarded as places of active propagation of the Covid-19 virus".
Regarding the MEL, in his decree, the prefect did not put forward a specific figure of contamination in sports halls either.
