The Prosecutor General's Office of the Russian Federation returned for further investigation the case of the Kirov "drunken" boy who died on July 13, 2019 under the wheels of a foreign car, which was driven by a policeman. 

As a representative of the family of the deceased boy told RT, the supervisory authority returned the case for further investigation after a complaint from the child's father.

According to her, when familiarizing themselves with the investigation materials, they found a number of documents that for some reason had not previously appeared in the case.

Among them - and the certificate of examination for the state of alcohol intoxication Menshikov.

Resonant accident

RT previously talked about a resonant accident that occurred on July 13, 2019 in the village of Buyskoye in the Kirov region.

A six-year-old child rode a bicycle from a dirt road to the main road, where he was hit by a Nissan Qashqai, at the wheel of which was Major Sergei Menshikov, an operational duty station of the Nemsky police.

According to eyewitnesses, the driver significantly exceeded the speed limit.

The boy died on the spot from his injuries.

Autotechnical and forensic examinations were carried out.

According to the results of the latter, at the time of the accident, the child was allegedly drunk.

Expert Sergei Nasonov found 0.51 ppm of alcohol in the child's blood.

However, later during interrogation, he admitted that alcohol could appear due to blood fermentation, since the body was not stored in the refrigerator.

In addition, the investigation established that Nasonov did not conduct an examination on July 13, the day of the accident, but only on the 15th.

A criminal case was initiated against the expert under Art.

293 of the Criminal Code of the Russian Federation "Negligence".

The investigation of the criminal case into the accident itself was taken over by the chairman of the RF IC, Alexander Bastrykin.

For a long time, Menshikov was a witness in the case, and only on May 29, 2020, he was charged under Part 3 of Art.

264 of the Criminal Code of the Russian Federation ("Violation of traffic rules, resulting in the death of a person by negligence").

The investigation established that Menshikov was driving at a speed of about 82 km / h with the permitted 60 km / h in the settlement and was able to avoid hitting the child.

Inconsistencies in the case

However, according to a representative of the boy's family, they discovered a number of oddities when they got acquainted with the case.

For example, in the course of an investigative experiment, it was established that a child was allegedly able to develop a speed of 16.9 km / h on a small bicycle in heavy rubber boots.

“But in the investigative experiment, the child was older and a different bicycle was used, the photos of which were included in the case,” a representative of the boy's family explains to RT. 

Also, the injured party raised many questions about Menshikov's certificate of alcohol intoxication.

According to them, the documents that the driver was sober appeared in the case materials only in March 2020 and allegedly do not correspond to reality.

As a result, the boy's father, Vladimir Suvorov, filed an application with the Prosecutor General's Office, listed everything that the injured party considers inconsistencies, and asked to find out.

In addition, as the lawyer notes, the investigation granted the petition of the boy's father, Vladimir Suvorov, to attach a video recording to the case file, which indicates that the grass and trees did not prevent the driver from seeing the child.

According to the lawyer, earlier in the case materials there was only a video recording from an investigative experiment, which was carried out in the fall.

By this time, the grass along the side of the road had been cut down, the trees along the road had been cut down, and the hole at the exit to the dirt road had been filled up. 

The driver, accused of the death of the child, after an investigative experiment, claimed that at the time of the accident the grass was high, and he allegedly did not notice the child behind it.

However, the father gave the investigators a record made the day after the accident.

“The video recording was made on July 14, 2019 and confirms that the trees and grass on the side of the road did not interfere with the driver's view of the car.

Having considered this petition, I come to the conclusion that it is subject to satisfaction in full, since this video helps to establish the circumstances of the road traffic accident that are important for the criminal case, ”the investigator wrote in the resolution.

In turn, Sergei Menshikov's lawyer Fyodor Konovalov told RT that he had not yet seen the video and would refrain from commenting.
