On September 26, local time, U.S. President Trump nominated Amy Coney Barrett, favored by conservatives, to replace Ruth Bader Ginsburg as the U.S. Justice of the Supreme Court.

Barrett, 48, was an assistant to the late Justice Antonin Scalia. She was conservative on issues such as gun possession, immigration and abortion.

In 2017, Barrett was nominated by Trump as a judge of the Seventh Circuit Court of Appeals.

With the announcement of this nomination, the U.S. Democratic and Republican parties will once again stir up controversy.

Why is the justice so important?

The Supreme Court of the United States is one of the "separation of powers" in the United States, which can interpret the constitution and overturn presidential executive orders or bills.

According to the 1869 judicial law, the number of justices of the Supreme Court is nine.

According to Article 2 of the U.S. Constitution, the President nominates judges of the Supreme Court, who are appointed after consultation and approval of the Senate.

Once a justice is appointed, he will be removed from office unless he dies, resigns, voluntarily retire, or is impeached by the House of Representatives and convicted by the Senate, and is therefore a "tenure."

The Supreme Court of the United States judges the Supreme Court cases with one vote each.

Although the U.S. Supreme Court should be an independent institution and not affected by the short-term federal government, recent parties have tended to nominate people who agree with their political ideas into the Supreme Court during their administration, so as to make decisions on issues such as immigration policy and medical insurance bills. Conducive to their own judgment.

Among the justices of the U.S. Supreme Court, 5 are nominated by the Republican President and 3 are nominated by the Democratic President.

The deceased Ginsberg was nominated by Democratic President Clinton in June 1993.

Why does the Democratic Party oppose?

Trump tried to nominate a conservative judge after the death of the legendary liberal judge Ginsberg, who was politically inclined to the Democratic Party.

The Democrats oppose any nomination of alternate judges at the moment. One of the reasons is that in 2016, Obama had nominated the candidate for the highest judge but was rejected by the Republicans in the Senate. At that time, the Republicans reasoned "too close to the election time."

Therefore, the Democrats believe that the Republicans are implementing double standards.

At present, Trump has appointed two Supreme Court justices during his term of office. If the nomination is passed, Trump will appoint 3 of the 9 Supreme Court justices.

Although the Democrats firmly oppose the nomination of any substitute judge, the Democrats are currently a minority in the Senate, so apart from calling on Republican senators to oppose the appointment, they cannot prevent the nomination of Justice Trump.

Trump wants a judicial ruling on the presidential election?

Trump told the White House press team that it is best to elect a new justice before the election, because "I think the Democrats are committing fraud, and this fraud will ultimately be decided by the Supreme Court."

Trump's so-called "fake" is due to the new crown pneumonia epidemic. Some regions in the United States will use mailed ballots to expand voting, relax relevant regulations and grant voting deadlines.

Trump accused the Democrats of "preparing for chaos" and making this election more prone to fraud.

Trump believes that if the ninth justice is not appointed under such circumstances, a 4 to 4 situation may be formed, causing the Supreme Court to stand in a stalemate in the face of legal challenges regarding the election results.

In 2000, the Democratic candidate Al Gore and the Republican candidate Bush Jr. disputed over the Florida ballot.

In the end, the Supreme Court's ruling allowed Bush Jr. as president.
