At the end of last week, on one of the houses in Krasnogorsk, local residents hung out a poster "In our pocket someone else's hand - MosObleIRTS and two UK".

Thus, they tried to draw attention to their problem: for about a year they receive double receipts for payment of utility bills.

As the residents of Krasnogorsk told RT, several companies are making payments to them.

“People are driven to despair, we complained to all instances, to the prosecutor’s office, the Ministry of Internal Affairs, and as a result, complaints are sent to our administration, which does not solve anything.

We are already ready to block the highway in order to somehow draw attention to our problems, "a resident of one of the problem houses told RT.

According to the residents, several companies claim to manage houses in the Stolichny microdistrict at once: ZhKKH-Online, which the State Housing Inspectorate appointed as a temporary management company, and old management companies (KKS and DEZ), which were deprived of licenses, but were able to challenge this decision in court.

At the same time, according to tenants, the companies do not fulfill their obligations.

“The houses are not serviced, the last floors are flooded, the interpanel seams are leaking, the mold is growing.

Both the Criminal Code do nothing, only send payments and penalty receipts, ”says Nikolai Rusanov, senior of one of the houses.

Residents fear that the buildings will be completely unprepared for the arrival of winter.

“No one watches the houses, just the janitors of different Criminal Code walk around the courtyards together and take pictures of each other, report on the alleged work done.

You have no idea what state we are in.

Not prepared for winter, the heating main has broken down, ”says Tamara, a resident of Krasnogorsk.

A criminal case has been initiated

As RT was told by the State Housing Inspection (GZI) in the Moscow region, in November 2019, the management companies DEZ and KKS working in Krasnogorsk were deprived of their licenses for repeated gross violations in their work.

Their houses (168 buildings) were given to the temporarily appointed Criminal Code - ZhKKH-Online.

“MC“ Housing and Communal Services-Online ”was appointed as a temporary management company for problem houses and from the end of last year to the present has the right to issue payment documents and collect fees from residents of apartment buildings,” the GZI explained.

They also noted that the old management companies do not have the right to collect money, since they do not actually manage this housing stock.

In April 2020, the GZI of the Moscow Region reported about double payments to the Ministry of Internal Affairs and the Prosecutor's Office, after which a criminal case was initiated against the old Criminal Code and now the evidence base is being collected.

However, representatives of the old management companies claim that they were able to achieve the cancellation of the decision to revoke licenses through the court, which means they have the right to service houses and collect payments from tenants.

Moreover, it is noted that representatives of the DEZ were able to win all the processes up to the cassation appeal, and the KKS won the appeal.

“We won the appeal, they didn’t go further, the decision came into legal force long ago.

It is unclear why it has not yet been fulfilled, "KKS told RT.

Dispute between business entities

At the same time, all management companies claim that they have the right to collect money from tenants.

“We are the only company that has the right to service these houses and collect money.

This is recorded in the GZI register.

What the DEZ and KKS are doing is a crime that law enforcement agencies are already doing, "ZhKKH-Online reported.

As explained in the Criminal Code, they are actively conducting explanatory work with residents.

"We just advise them to look at the official register to understand who is attached to their house," said the interlocutor of RT.

At the same time, as they admitted, debts are growing rapidly.

Some tenants pay to old companies, others to new ones, and most simply decided not to pay until the situation is cleared up.

"The debt has exceeded one hundred million rubles, and in fact winter is not far off, we need to prepare for a new heating season," - noted in "Housing and Communal Services Online".

The head of DEZ LLC Dmitry Kuznetsov, in turn, claims that the actions of LLC MC ZhKKH-Online fall under the provisions of the Criminal Code of the Russian Federation - Articles 159 ("Fraud") and 315 ("Failure to comply with a court sentence, court decision or other judicial act ").

“The court refused to“ ZhKKH-Online ”in the demand to transfer the technical documentation, since the MC“ ZhKKH-Online ”has no legal right to demand that the technical documentation be transferred to it,” he stressed.

KKS also stated that they are the only legal managers.

“All claims of GZI were contested in the courts, we did not have any gross violations.

The decision of the administration on the appointment of a temporary Criminal Code was declared illegal by the court, ”a company representative said.

Unnecessary fund

Commenting on the current situation, a member of the public chamber Artyom Kiryanov stated that this is far from a unique case.

“Such controversial situations are common.

But we must understand that this is not a redistribution of the market.

Because they are not so fighting for the housing and communal services market.

They are fighting for profitable, good houses, new buildings, and most of the housing stock is not so interesting.

These are accumulated debts, dilapidated communications, and so on.

Few will take on the balance of rapidly dilapidated housing, "he said.

At the same time, he added that often the tenants themselves, by their passivity, indulge the scammers.

“The low activity of residents at general meetings also plays a role.

An indifferent attitude towards the problems of servicing one's property leads to manipulations and fraud.

And in this situation, everything can reach the criminal courts.

If the license was deprived illegally, then there could be forgery of documents, falsification of the results of the meeting, ”Kiryanov said.

In his opinion, the fears of residents who do not know who to pay are fully justified.

“If the license was revoked incorrectly, then the appointment of the new company and everything that it has done during this time must be recognized as null and void.

People need to know about this.

It may happen that none of the companies will eventually bring money to the address, ”says Kiryanov.

The situation became known to the governor of the Moscow region, Andrei Vorobyov, who demanded that the local authorities solve the problem as soon as possible.

According to him, because of the incompetent actions of several officials who did not take timely measures, "the negative falls on the authorities at all levels."

The head of the city district of Krasnogorsk, Elmira Khaimurzina, said that representatives of the authorities held meetings with residents, where they gave explanations about the reason for the change of the Criminal Code and who to pay for utilities.

She added that in relation to the Criminal Code, which illegally issue payments, all necessary measures should be taken.

As reported in the administration of the municipality, on September 24, a meeting with residents will be held with the participation of representatives of the authorities, GZI, resource supply companies and councils of apartment buildings.

Its main topics will be issues of debt for utilities and clarifications on payments for utilities.
