The details of the case, according to the medical report issued by the Supreme Committee for Medical Responsibility, is that (the patient) underwent surgery in the hospital affiliated with the stab by a doctor, where the posterior vertebral arch of the fourth lumbar vertebra was removed, a spinal disc for the fourth and fifth vertebrae was removed, the disc fragmentation was removed, and the disc was reduced. Pressing on the nerves while releasing them, then followed them with several surgeries, and the patient was discharged from the hospital while he was in a wheelchair, and then he submitted a complaint to the competent health authority, which referred it to the Higher Committee for Medical Responsibility for research, as its report concluded that the patient could not walk or stand. But he moves with a wheelchair and cannot control passing, urine and faeces, lack of sexual activity after the operation, and using a foot preservative from falling and a complete fall of the feet.

The report confirmed that the patient was completely paralyzed in the diastolic and systolic movement of the feet, and a weak sensation on the feet, as a result of medical errors by the affiliates of the stabbing company, where the attending physician made a mistake, and did not discover the mechanical imbalance of the vertebrae after the operation, and the paralysis of the feet, problems of urination and sexual organs was caused by Sliding of the fourth and fifth lumbar vertebrae, and mechanical instability between them.

The report indicated that the doctor neglected the patient, who visited the hospital four times, complaining of pain and pus coming out of the place of the wound, and there was insufficient attention until after the patient’s family urged him to be admitted to the hospital, and the Court of Appeal ruled the responsibility of the appellant (the hospital) for the mistakes of her followers, and obligated her to Pay to the respondent a compensation of one million 500 thousand dirhams.

The Court of Cassation indicated that the appealed judgment established its judiciary in establishing the responsibility of the contestant on the findings of the report of the Supreme Committee for Medical Liability regarding proof of medical error, and the forensic doctor's report regarding the determination of injuries, disabilities and the percentage of disability after he was assured of the safety of the foundations and the sufficiency of research. , Pointing out that the damages sustained by the respondent, as a result of medical errors, affected the patient's ability to carry out his work and personal work by himself, and left him with permanent disabilities.

The court pointed out that the moral damage is represented in the pain he suffered as a result of the wrong operations that were performed on him, and his feeling of grief, sadness and sorrow for what he suffered.

The court ruled not to accept the appeal and required the appellant to pay the fees and expenses, and an amount of 1000 dirhams for attorneys' fees for the respondent, and ordered the confiscation of the insurance.

Negligence by the doctor caused the patient to be 100% paralyzed in the lower extremities.
