The Court of Cassation in Abu Dhabi upheld a ruling issued by the Court of Appeal, which decided to compensate an employee for her dismissal from work at an amount of 51 thousand dirhams, and the court rejected the appeal submitted by the employee to demand her return to work, and compensation for the material and moral damages suffered by her, in the amount of 150 thousand dirhams, and obligated her to pay expenses.

The details of the case refer to the plaintiff’s joining of work for the respondent and terminating her services without cause on her part, and then she instituted the case to request a ruling for her entitlements.

The Court of First Instance ruled to compel the respondent to pay the contestant an amount of 13 thousand and 84 dirhams, for the end of service gratuity allowance, and 5336 dirhams for the warning allowance, and 11 thousand and 435 dirhams as compensation for unfair dismissal, so that the total amount decided is 29 thousand and 856 dirhams.

It also obliged the respondent to pay the contestant a travel ticket for the party from which it was brought in in the event that she left the state’s territory, and to give her a certificate of experience, while keeping the contestant in the housing provided to her by him until she received her rights, and she refused to return the appellant to her work, as she refused the leave allowance, Allowance for overtime hours, public holidays, and claimed back salaries.

The appellant appealed the judgment and the court ruled to amend the appealed judgment regarding compensation for unfair dismissal and the judiciary to oblige the appellant to pay the contestant an amount of 32 thousand and 688 dirhams instead of the arbitrary dismissal, so that the total amount decided upon after the amendment becomes 51 thousand and 109 dirhams, so the appellant challenged the judgment by way of cassation, and requested the judgment The invalidation of the decision to dismiss her from work and the consequences thereof, return her to work, and pay her salaries until the date of return to work, and as a precaution to oblige the respondent to pay her late wages in the amount of 16 thousand dirhams and the end of service gratuity of 43 thousand dirhams, and a leave allowance for four years in the amount 43,000 dirhams, an unfair dismissal allowance of 32,000 dirhams, a month’s salary for a warning, overtime and official holidays allowance, a certificate of experience, a travel ticket or its allowance, compensation for material and moral damages of 150,000 dirhams, and staying in the provided housing for her from the contested Until it receives its rights.
