Elman Pashayev, who defended the actor Mikhail Efremov in the case of a fatal accident, was deprived of his lawyer status.

The corresponding decision was made by the Chamber of Lawyers of North Ossetia, RIA Novosti reports with reference to the Federal Chamber of Lawyers (FPA).

President of the Chamber of Lawyers of North Ossetia Mark Gagloyev specified that a lawyer can appeal this decision in court.

FPA President Yuri Pilipenko called the decision “the most adequate in the current situation”.

“If it were not for the level of scandal that was set by Elman Pashayev himself, the disciplinary proceedings might not have taken place or ended with another measure of punishment,” said Pilipenko.

FPA vice-president Gennady Sharov noted earlier that the experts assessed not Pashayev's legal position, but the ethics of his behavior.

Before the meeting of the Council of the Bar Association of North Ossetia, Elman Pashayev said that he expects a "fair decision", and also admitted that he values ​​the status of a lawyer.

Pashayev also read a letter from Mikhail Efremov to journalists in Vladikavkaz, where he asks the chamber to dismiss the case against the lawyer.

“Pashayev does his job as a defender in a highly professional manner, all his interactions with journalists, the media take place exclusively at my request and in my interests, he does not divulge the attorney's secret,” the lawyer read out.

After the meeting, the lawyer said that he intends to return the status in a year, adding that he does not agree with the decision of the council.

We will act in the legal field, ”he answered the question about his intention to appeal the decision.

Speaking about plans for the coming year, Pashayev said that he intends to go about his own affairs - "civil, arbitration, family."

We will remind, Pashayev acted as the lawyer of Mikhail Efremov during the consideration of the case about the accident that occurred on June 8 on Smolenskaya Square.

The artist, driving in a Jeep Grand Cherokee, drove into the oncoming lane and collided with a Lada van, whose driver Sergey Zakharov died from his injuries.

Immediately after the accident, Efremov pleaded guilty and asked for forgiveness from the family of the deceased, but later said that he did not remember whether he was driving on the day of the accident, and explained the confession by saying that he was "nervous with a hangover."

Pashayev insisted on the artist's innocence, claiming that at the time of the accident another person was driving the car.

The video, in which eyewitnesses help Efremov to get out of the car, Pashayev called a fake.

The Presnensky court rejected the arguments of the defense, who argued that Efremov was in the passenger seat at the time of the accident, noting that they were "refuted by the evidence."

Mikhail Efremov was found guilty of violating traffic rules, resulting in the death of a person by negligence and committed in a state of intoxication, and sentenced to eight years in prison.

In July, the FPA opened disciplinary proceedings against Elman Pashayev, as well as the lawyer of the injured party in the case of Efremov, Alexander Dobrovinsky.

The chamber pointed out the violation of professional ethics by lawyers "in connection with their public activity in a resonant case," noting that the behavior of lawyers in the media sphere should be "restrained and balanced." 

The case against Dobrovinsky, as reported by TASS, is being considered by the qualification commission of the Moscow Bar Association.

On September 10, the Ministry of Justice proposed terminating Pashayev's status and initiating disciplinary proceedings against Dobrovinsky.

The department noted that the statements of lawyers contain signs of "violations of the legislation on advocacy and the legal profession and the Code of Professional Ethics of Lawyers, as well as demonstrate a disdain for the rules of the legal profession and indicate a disregard for corporate discipline, ethics and morality."
