China News Agency reporter Zhang Su

10,603, 13,445, and 19,338. This is the number of Chinese prosecutors prosecuting rape, forced indecency, child molestation and other crimes of sexual assault on minors from 2017 to 2019.

In this year, the police have uncovered more than 12,000 cases of sexual assault on minors, such as rape, forced indecency, and child molestation.

The data is shocking, and the results of the judicial department's judgment on the case are even more worrying.

For example, the crime of sexual assault on minors is characterized by a high proportion of acquaintances committing crimes and a high rate of re-offending. In recent years, there have been many cases of sexual assault criminals who continue to sexually assault students; another example is the use of the Internet as a medium to lure and intimidate minors. The indecent assault conducted by people in the form of "naked chat" has become a new form of sexual assault on minors, which has the characteristics of greater concealment and wider harm.

The training organization "Global Master" was found to have molested a girl, and the kindergarten cook was actually a released prisoner who raped his niece.

China’s Supreme People’s Procuratorate issued a typical case of faculty and staff access inquiries on illegal and criminal information on the 18th, which shows that it is imperative to keep the "big bad wolf" out of campus.

"It is necessary to establish an entry inquiry system as soon as possible, and do our best to protect our children from harm." Shi Weizhong, Director of the Ninth Procuratorate of the Supreme People’s Procuratorate of China, said at a press conference held in Beijing on the 18th. Move forward and strengthen prevention at the source.

This time, the Supreme People’s Procuratorate, the Ministry of Education, and the Ministry of Public Security took the opportunity to jointly issue the "Opinions on Establishing an Information System for Teaching and Staff Access and Inquiry on Sexual Assaults and Crimes" (hereinafter referred to as the "Opinions") to move the preventive barrier to the entry review stage .

Specifically, before new faculty members are recruited in elementary and secondary schools and kindergartens, the teacher qualification certification agency shall conduct information on sexual assault and criminal offences before granting the applicant’s teacher qualifications. Persons with sexual assault and criminal records shall not be hired or Not to be recognized as a teacher.

The reporter learned that as early as August 2017, Shanghai was the first to explore the establishment of a mechanism for restricting employment of persons involved in sexual assault and criminals. Procuratorial authorities in Zhejiang, Chongqing, Guangdong and other places have also launched institutional mechanisms in conjunction with relevant departments.

In July 2019, the Chongqing prosecutors developed and constructed the country's first provincial-level faculty and staff entry inquiry platform.

After many explorations, the system design is relatively mature.

Li Feng, deputy director of the Ninth Procuratorate of the Supreme People’s Procuratorate of China, believes that through the introduction of the "Opinions", the recruitment inquiry system will be implemented nationwide. In particular, relying on the national information system for sexual assault and criminals established by the Ministry of Public Security to achieve a national level The sharing of infringement and criminal information will effectively plug loopholes.

Talking about how to implement the system, Huang Wei, deputy director of the Teacher Work Department of the Ministry of Education of China, introduced relevant deployments at the press conference, such as establishing an information sharing mechanism.

He also emphasized that if the local education administrative department did not inquire about the sexual assault and criminal information of faculty and staff, or the local education administrative department or the school still recruited the relevant information on the illegal crime after the inquiry, the relevant education administrative department and the school should be investigated. Personnel responsibility".

Wang Yongming, the second-level inspector of the Criminal Investigation Bureau of the Ministry of Public Security of China, said that the public security organs will continue to improve the nationwide information system for criminals who violate the law.

They will further strengthen intelligence research and judgment and make every effort to prevent such crimes from happening.

At this press conference, the official expressed the determination to continue to weave the "law net" to protect minors and to protect the "pure land" of minors' growth.

On the one hand is the improvement of the "Opinions".

Although the current "Opinions" covers all people who have close contact with school minors, it only applies to primary and secondary schools and kindergartens, and the scope of the inquiry is also limited to sexual assault and crimes.

Shi Weizhong revealed that with the implementation of legal amendments such as the Juvenile Protection Law, the prohibition of employment will continue to be expanded and gradually extended to all industries that have close contact with minors.

In fact, when exploring, some localities have expanded the scope of inquiry to organize, lure, contain, introduce prostitution and other related crimes.

The typical cases issued by the Supreme Procuratorate on the same day also involved drug-related crimes and illegal crimes such as organizing and hosting prostitution.

On the other hand, continue to implement a "one-stop" inquiry and rescue mechanism.

Wang Yongming explained that the “one-stop evidence collection” approach for sexual assault cases of minors is that after the public security organ receives the relevant case, the public security criminal investigation department, technical appraisal department, and procuratorial organ are present at the same time, and at the same time cooperate with the Women’s Federation, health, judicial, and medical institutions. With the participation of such units, professionals complete all the evidence collection work at the litigation stage at one time, and simultaneously carry out children's psychological trauma assessment and treatment, physical rehabilitation, family function counseling, legal assistance, judicial assistance, etc.

This prevents the victim from suffering "secondary harm" in the process of repeated interrogation and evidence collection.

Li Feng said that 478 "one-stop" inquiry case-handling areas have been established nationwide.

The Supreme People's Procuratorate requires that at least one "one-stop" case-handling site for juvenile victims with the functions of collecting evidence and providing assistance should be established in each city (state) before the end of this year.
