This week, the Court of Cassation confirmed the decision of the Court of Appeal which in July 2019 ordered a resident of Froidfond in Vendée to destroy his swimming pool because he did not have official authorization to build it, according to

This 71-year-old Vendée had dug, but the mayor of the town had drawn up a report in May 2016 because the area - in which the septuagenarian lives - was agricultural.

There was therefore a ban on building a non-agricultural structure in this area.

The defendant not being a farmer, no regularization was possible according to the Tribunal des Sables d'Olonne in July 2017 and then according to the Court of Appeal in July 2019.

Four months to destroy his swimming pool

According to

, the septuagenarian relied on incorrect information given by a tax service, which allegedly told him that no authorization was necessary for the construction of his swimming pool.

He was not heard by the judges.

The owner was therefore fined 1,500 euros, 3,000 euros in damages to be paid to the municipality in addition to 1,200 euros for procedural costs.

He is now obliged to demolish the swimming pool within four months (from this week), under penalty of a fine of 30 euros per day once this period has expired, indicates the daily.
