A man was fined 45,000 dirhams for breaking into a woman's house

The Abu Dhabi Appeals Court upheld the ruling of the Court of First Instance requiring a man to pay a woman 45,000 dirhams in compensation for breaking into her home without her will and without legal justification, and the court rejected the woman’s appeal to increase the amount, as well as the man’s appeal to reduce the amount.

The woman had requested that he be obligated to pay her a material and moral compensation in the amount of 100 thousand dirhams at an interest of 12% for what was assigned to him from entering her home without her will and without legal justification, and the court ruled in the civil lawsuit obliging him to pay her 45 thousand dirhams in compensation for her moral and material damages and the benefit of delay by the amount of 5% annually as that court becomes final.

The convicted person did not agree in her favor and lodged her appeal against him, and demanded that the judgment be amended by increasing the amount of compensation awarded to her to the amount received in her requests before the first degree, indicating in her appeal that she defects the judgment due to the small amount of compensation that is not commensurate with the material damages caused to her by litigation expenses and legal fees, as well as Literary damages to her grief and psychological suffering as a result of the appellee’s crime, and the consequent mistrust of her reputation.

In turn, the appellant submitted his memorandum requesting the rejection of the appeal and reducing the amount of compensation awarded.

Whereas, the Appeal Court indicated that the two appeals were accepted in form, rejected and confirmed the appealed judgment, and obligated each appellant to pay his appeal fees and an amount of 500 dirhams as legal fees.
