• 'Villarejo Case' Corinna relies on the Prosecutor's Office to now ask the judge to file the case

  • Investigation Juan Carlos I transferred two million euros to Corinna from Panama to buy two apartments in the Swiss Alps

  • Anti-corruption. Corinna's investigation deflates: the Prosecutor's Office concludes that Villarejo was no longer a commissioner when the alleged commission took place

The head of the

Central Court of Instruction Number 6

of the National Court,

Manuel García Castellón

, has rejected the appeal filed by the defense of the German businesswoman Corinna Larsen, to which the

Anti-Corruption Prosecutor's Office

joined

, requesting the file of the

Carol piece

.

In a car, to which EL MUNDO has had access, the judge reproaches prosecutors

Ignacio Stampa

and

Miguel Serrano

for supporting the revocation of the order to reopen the separate piece on the basis of the lack of a "procedural procedural budget", and the requirement of the filing of a prior complaint to be able to investigate the alleged commission that the former close friend of King Juan Carlos I made to Commissioner José Manuel Villarejo when "without having practiced diligence" it is not possible to clarify "where the crime was committed."

The magistrate understands that the

Anticorruption

position

is "hasty."

"It is difficult to specify the territorial connection, determine the place where the request was made to Mrs. Larsen, find out if she was the one who made the offer, clarify if there was an acceptance or receipt of the alleged offer, etc., without, at least , having carried out a minimum and essential investigation procedures, such as hearing the affected persons, under conditions that allow all parties to defend themselves on equal terms, "the judge responds.

In addition, García Castellón affirms that it results from "a lack of procedural coherence" to verify that an alleged defenselessness is alleged by the representation of Corinna Larsen for the reopening of the

Carol piece

, aimed at clarifying whether there was indeed a commission on his part towards the commissioner José Manuel Villarejo, "and that, nevertheless, it is of interest to maintain the validity of a file order that urged the initiation of pre-trial investigation proceedings, outside of the criminal procedure, in which the investigated had no opportunity to intervene".

Judge Manuel García Castellón agreed to reopen this piece of the

Tandem case

without seeking the prior opinion of the Public Prosecutor's Office.

When later, the togado asked the prosecutors to report on the possible existence of criminal connection, as well as on the competence of the Spanish jurisdiction to know the facts, the Anticorruption response was loaded with reproaches towards the instructor.

Prosecutors said, for example, that "no other piece of information related to the order - from Larsen to Villarejo - had been found that objectively and minimally corroborates that it was carried out."

The instructor now buries both Larsen's claims and those of the prosecutors in a car, although the last word will be given to the

Criminal Chamber

of the National Court.
