Abu Dhabi Court of First Instance ruled to oblige a person to pay the last amount of 250 thousand dirhams, the value of the trust receipt he had issued and denied the validity of his signature, noting in its ruling that Article 112 of the Civil Transactions Law recognized that “evidence of truth is writing, testimony and an oath”, and that the judiciary is to be decided The burden of proving the claimed right rests with whoever claims it.

The details of the case are due to the defendant issuing the receipt of a trust bond in the amount of 250 thousand dirhams to the plaintiff, and he refused to pay despite the plaintiff’s repeated request to him. And judging again that the court does not have jurisdiction to hear the dispute, and refer the file to the Abu Dhabi Court of First Instance.

The two parties exchanged the notes, the defendant denied his signature, and falsified the plaintiff's document, and the parties exchanged the notes, each of them resolved on his requests and defense, and the plaintiff requested the legal interest at 12% from the date of the claim, in addition to the amount subject to the lawsuit.

The forensic laboratory report showed that the signature attached to the editor of the plaintiff’s deed belongs to the defendant, and that it is technically unable to know whether any of the data contained in that document have been added later or not.

The plaintiff took a complementary oath before the court, according to the following formula: “I swear by God Almighty that the defendant owes me an amount of 250 thousand dirhams, and that his liability is still occupied for me with the full amount of this amount, and God is a martyr.” The court ruled to compel the defendant to pay the plaintiff an amount 250 thousand dirhams, and obligated the defendant to pay fees, expenses and fees.
