The "Draft for Solicitation of Comments" clearly stated that kindergartens must not teach the content of elementary school education, and must not carry out activities that violate the laws of physical and mental development of preschool children.

  The "Draft for Solicitation of Comments" is divided into nine chapters: general rules, planning and holding of preschool children, kindergartens, childcare and education, teachers and other staff, management and supervision, investment and protection, legal responsibilities, and supplementary provisions.

  The general rule clarifies that the development of preschool education should adhere to the government's leadership, mainly organized by the government, vigorously develop inclusive preschool education resources, and encourage, support and regulate the participation of social forces.

The country universalizes pre-school education, builds a structure covering urban and rural areas, has a reasonable layout, and has clear public welfare for pre-school children. The state guarantees the right to education of pre-school children.

  The chapter on pre-school children is clear that pre-school children entering kindergartens and other pre-school education institutions to receive pre-school education, except for necessary physical health checks, shall not organize any form of examination or test.

No organization or individual may organize preschool children to participate in commercial activities, competition activities, and other activities that violate the age characteristics and physical and mental development of preschool children.

  The chapters on the planning and holding of the kindergarten are clear, and the kindergarten should be built in accordance with the relevant national and local standards for newly-built residential communities (residential communities), old towns and shantytowns, and relocation for poverty alleviation.

The construction and development unit shall ensure that the supporting kindergarten is planned, designed, constructed, checked and delivered simultaneously with the residential area constructed in the first phase, and used as a public service facility with the property rights transferred to the local people's government to be used as a public kindergarten.

If the supporting kindergartens cannot meet the needs of school-age children in the area, the county-level people's government should make overall plans to solve them through new construction, expansion, and the use of public facilities.

Encourage and support enterprises, institutions, social organizations, etc. to set up kindergartens, provide convenience for the children of employees of the unit to receive preschool education, and provide inclusive preschool education services to the society.

  It is also mentioned in this chapter that no organization or individual may use financial funds, state-owned assets, or collective assets to run or support for-profit kindergartens.

Public kindergartens may not be transformed into private kindergartens.

Public kindergartens may not run or participate in the running of for-profit private kindergartens and other educational institutions.

Social capital shall not control public kindergartens and non-profit private kindergartens through mergers and acquisitions, entrusted operations, franchise chains, use of variable interest entities, and agreement control.

  The chapter on childcare and education clarifies that kindergartens should be based on children’s lives, to maximize support and meet the needs of children to gain experience through closeness to nature, practical operations, and personal experience, and promote children’s health, language, society, science, and art. Coordinated development in all aspects.

Kindergartens shall be equipped with toys, teaching aids and picture books for children that meet relevant national and local standards, and no textbooks shall be used.

Kindergartens shall not teach the content of education at the elementary level, and shall not carry out activities that violate the laws of physical and mental development of preschool children.

Kindergartens must not charge fees in violation of national regulations, and must not solicit textbooks and teaching supplementary materials from preschool children and their parents, or sell or sell goods and services in a disguised form.

Off-campus training institutions and other educational institutions shall not conduct half-time or full-time training for preschool children.

  The chapter on teachers and other staff is clear, and the state implements a qualification system for kindergarten teachers.

Kindergarten teachers shall obtain kindergarten teacher qualifications; those who have obtained other teacher qualifications may teach in kindergartens only after they have obtained professional training organized by the education administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government and obtained a qualification certificate.

Before hiring teachers, childcare workers, health care personnel or other staff, kindergartens should conduct background inquiries. Those who have one of the following circumstances shall not be hired: (1) Deprived of political rights or have a criminal record; (2) Due to abuse Children, sexual assault, sexual harassment and other behaviors are subject to public security management penalties or administrative sanctions; (3) Those who have illegal or bad behavior records such as drug abuse, alcohol abuse, gambling, etc.; (4) Those who suffer from mental illness or have a history of mental illness; 5) There are serious violations of teacher ethics; (6) There are other situations that may endanger the physical and mental safety of children and are not suitable for preschool education.

  The chapter on management and supervision clarifies that people's governments at or above the county level should establish and improve preschool education budget management and audit and supervision systems.

No organization or individual may embezzle or misappropriate funds for preschool education, or illegally collect or apportion fees from kindergartens.

  The chapter on investment and guarantee is clear. Pre-school education implements a mechanism of government investment, reasonable family burden, and other multi-channel funding mechanisms.

The kindergarten fund is raised by the organizer in accordance with the law to ensure a stable source of funding.

The State Council and local people's governments at all levels shall gradually increase the level of financial investment and support for preschool education, and ensure that the financial expenditure for preschool education accounts for a reasonable proportion of the financial expenditure for education at the same level.

The state encourages enterprises, institutions, social organizations, and other social organizations and individuals to donate to preschool education.

  The chapter on legal responsibility clarifies that if relevant departments of the State Council and local people’s governments at all levels violate the provisions of this law and fail to perform their preschool education management and guarantee duties, the State Council or the higher-level people’s government shall order corrections within a time limit; if the circumstances are serious, the directly responsible person in charge And other directly responsible persons shall be punished according to law.

In addition, the "Draft for Comments" also clarified the content of leadership responsibility, construction responsibility, unauthorized organization, institutional responsibility, profit-seeking responsibility, personnel responsibility, and tort liability.
