The Kalba Court rejected a fault-based divorce filed by a Gulf wife against her husband on the pretext of marrying another woman, breaking an agreement between them not to interfere in her affairs, and the court obliged the wife to enter into obedience to the husband.

And when the court asked the wife about the harm that had befallen her, she said, “My husband married another woman without real reasons that require that, which made me desert him in bed and ask him not to interfere in my affairs and my going out and entering the house,” indicating that at the beginning he agreed to all her requests and did not interfere In her life and the lives of her children.

She pointed out that she continued to spend on her children and meet their needs of food, drink and clothing, in addition to their studies without the need for her husband, but in the recent period he began to harass her and interfere in her affairs and the affairs of their children, following up that she tried to convince him through understanding and discussion not to violate the agreement between them for years However, he did not respond, which led her to file for divorce due to harm.

For his part, the husband said that divorce is not the solution, and that his marriage to another woman is permissible and legitimate and is not punishable by law, continuing that at the beginning he thought that his wife’s nervousness stemmed from jealousy and just simple family problems and time would solve it, which made him respond to his wife’s demands not to interfere in Her affairs, except that he cannot leave her at ease while she is in his custody, and he must ask her where she is going, and she must abide by his conditions at home and there is no harm in that.

For its part, the Sharia court ruled divorce due to harm, but the judgment was appealed and rejected, and the wife was obliged to enter into obedience to the husband to not prove the harm to her convincingly and seriously.
